    I consigned a 2003 horse trailer with *** **** at Kingdom Trailers in *********. When I dropped off the trailer in Sept 2024, the only issue I was aware of was a broken window in the dressing area. The trailer was sold on April of 2025 after being listed a few weeks. I found out the trailer had sold by looking at their website. I called numerous times asking about the sale and the breakdown of what I was to receive. I had given the company a range of an acceptable amount to sell my trailer. It sold for ~ ****** which was the asking price. I received a check in the mail, never a call back, for ~****** and a breakdown that showed ~7500 in repairs that had been completed prior to selling the trailer. I only authorized the window to be replaced which was approximately $600. Despite *** telling me that he should have called me with the findings of their in house inspection as that was part of their process and my expectation prior to repairs that never happened. I have tried to resolve the issue since the trailer is sold and I have no way of getting the trailer back as it is sold and with new owners. He offered $882 to resolve this issue. I asked for $3000 to be fair as I never authorized the ~7500 repairs nor was given a chance to pick up my trailer which *** **** refused. I did not authorize a blank check for repairs for the trailer nor would I have authorized ~ 7500 in repairs, only the . ~600 cost of the window. The in house repairs and labor costs were astronomical and all benefited the company. The communication was poor from the beginning with me calling and writing emails as to the status of the trailer being listed. When I finally got a response he told me that he was going to list it on the Spring, which is when the consignment agreement ended. I was never contacted about the alleged needed repairs, was not kept advised of the status of the sale. I would accept 3000 returned to settle this issue. See text chain attached.

    Please find attached a paper trail of the consignment trailer we sold on behalf of Ms. ************** While I am not accusing anyone of misrepresentation, almost every person who brings us a trailer either claims or believes their trailer is in perfect condition.  Ms. ******* claimed on the morning of dropping off the trailer that she didn't even realize the window was broken until that very morning.

    We inform our consignors both verbally and in writing (highlighted contract copy attached) that will put the money into their trailer that it needs to pass inspection and then take it off the top at the end. Please note her initials almost touching the paragraph that says so.

    She claims the labor charged was outrageous, yet I doubt she has any context or knowledge of how long it takes to replace or repair 23 light fixtures or the other items repaired. As our hundreds of reviews reflect we take service seriously and try to make every customer a raving fan.  But I can not do so when a person believes their trailer needs nothing and won't acknowledge they have already authorized whatever repairs were necessary. We offered a good faith handshake with a piece of our commission (which has been mailed) but instead Ms. ******* wants more than the even the minimum she agreed to as if there were no repairs at all. I have done what I believe is more than reasonable given the condition of her trailer and the services provided. Please feel free to call me with any questions.

    I am rejecting this response because: Mr. **** continually refers to the minimum I would accept.  The trailer was sold for the list price of $26,500, that is the sale amount we are discussing.  I reported the broken window to Mr. ***** I went around and inside and outside of the trailer the morning before hauling the long distance to him.  At the time all of the lights were functioning and I noticed the window was broken and reported it to Mr. ***** That was the only repair that I authorized which amounted to approximately $600 which was what my initials and verbal communication were with him at the time.  I did not authorize any additional repairs and he admits there was a process fail during the transaction and admits and apologizes that they neglected to send the estimate to me prior to completing any work.   Had he contacted me I would have gone and picked up the trailer.  I was never given that option, the trailer was repaired and sold prior to me knowing anything about the repairs or sale. This is a deceptive business practice.  I never would have authorized 50% of the amount I received for the sale in repairs.  Mr. **** should be responsible for the failure of the process of his company, which cost me an additional $6900 in unexpected fees.  All of the repairs were conducted in house by his company.  I will accept a total of $3000 in addition to the ~ $15,200 I received previously.

    I'm not really sure how to respond.  The customer clearly misrepresented the condition of her trailer whether by mistake or intentionally. Our contract is clear as day that we will fix anything required to pass inspection and then it will be deducted from sale proceeds prior to the split. I don't know why she didn't get an electronic notice of what repair were needed but that is done as a courtesy, not to ask permission.  Permission to repair has already been given in the contract which she initialed next to.

    We treat everyone with honesty and respect and run an ethical business. I even gave her a portion of our sales commission as a courtesy yet she feels entitled to more. I find it interesting that the default assumption is that a business misrepresented something to a client instead of realizing the client has misrepresented things to the business.  My conscious is clear and our contract is clear.  I would love to hear the opinion of the BBB, but we did the job we were hired to do within the terms of our contract and I consider this matter closed.

    I am rejecting this response because:

    1). I did not authorize any other repairs than the window (approximately $500) which I reported to Mr. *****  That was what we discussed when I brought the trailer to him.  The estimate does not have my signature on it.  If the trailer was in such poor condition as he alleges, why did he not contact me to advise?  The trailer was on his lot for more than 5 months prior to it even being inspected.  

    2). With Mr. **** response, theoretically, any amount of repairs could have been authorized by him, without my consent?  This cannot be legal or ethical.  He could have authorized up to the price of the trailer itself?  Then sold it, I make little to no $$ and he and his company make all of it?  As it stands, he authorized 50% of my net on the trailer.  He is employing deceptive business practices by operating in this manner.  Unfortunately, it seems he iis creating a narrative around this situation.  He apologizes for lack of communication and acknowledges that part of the process was to advise me of the inspection findings, which he failed to do.  

    3). I did not know the trailer was even sold until I saw it on the website.  It leads me to believe there was an expectation for me to just accept the check when I received it, without even knowing what to expect and just accepting my losses.  

    4)  I never would have authorized the amount of repairs nor the cost of repairs.  

    5). I believe I am being more than reasonable by asking for $3,000 more than the initial $15,291.55, which is less than half the cost of the unauthorized repairs.  

    6)  He had every opportunity to contact me and provide the expected communication when one entrusts the sale of a trailer or any item.
