    Carlisle home owners association is refusing to release my parking permits to me. They are demanding (estorting) $665.76 from me where by my HOA had been paid. I can not park in front of my own house because of that.Thank you

    The consumer complainant, ******** ******, is the owner of a townhouse in the Carlisle Homeowners Association,Inc., (Carlisle) which is managed by ******************************** (PMP),Agent.

    Each property in Carlisle is assigned two (2) reserved parking spaces contingent upon several conditions as stated in the attached parking resolution. 

    The first condition is the requirement for the homeowner to pay their obligatory monthly homeowner association assessments.  Failure to do so results in the automatic removal of assigned parking spaces.   The revocation period is sixty (60) days.  On the 61st day, the Association can remove the reserved parking and invalidate the resident and guest parking tags issued.  Copy of parking policy resolution attached. 

    The complainant is substantially more than 60 days delinquent in the payment of her assessments.  Her account has been forwarded to the Associations attorney for collection and she has been provided the attorneys contact information.  ********** has been informed she has communicated with the attorneys office. 

    We cannot comment further on the status of the complainants account at this time.

    To resolve this complaint, the complainant needs to contact the Associations attorney and arrange to bring her account current.  Once her account is current and she has no other violations, we will happily and quickly issue the reserved parking permits.

    I am rejecting this response because:
    I have been paying my HOA. There is nothing like assessment nor nothing sent to me pertaining to assessment for all home owners. It was sent to an attorney as stated. I contacted the attorney but is still insisting to pay $600.00 for assessment even though I showed proof of payments . I requested for the signed copy of packing permit but had not received it.

    Attached is a copy of the Complainant's account with ********************************************************************. 

    Each property within Carlisle Homeowners Association, is also an automatic member of The Highlands at ********* Homeowners Association, the Umbrella community.  Highlands at ********* has a clubhouse, pool, tot lot and parking that all 237 members of Carlisle Homeowners Association and 98 members of Braemar Condominiums are entitled to use if they are current in their assessments.  All property owners in Carlisle and Braemar are required to pay monthly assessments to "both" associations.  

    As the statement indicates the Complainant is delinquent in the amount of $688.60.   That is why her reserved parking privileges in Carlisle have been revoked.

    The attached statement shows each transaction since the Complainant purchased the property in February of 2020.  The last time the Complainant was current in her association assessments was March of 2020.  Since that time, she has been delinquent.

    The column "Check Payment #" indicates the check number and received date of each payment our office has received.  

    If the Complainant has made payments not reflected on the attached account ledger, she needs to bring proof of payment (copy of processed check or bank statement) that confirms the payment was made.  Her last visit she brought checkbook copies of checks written (See attached) which are not proof of payment.  Both checks, numbers 446 and 536, were processed and posted to her account.

    Both parties are aware of the full payments received. There are two assigned parking for me and two for visitors.

    The Association and Attorney's records agree.  The Complainant is more than $700.00 delinquent as of July 1, 2023.   Since she refuses to pay the past due amounts, our recommendation is we go to court and let the judge decide.

    The ******************************** professionals and the HOA's attorney have both met with the Complainant, in person, and reviewed her account. 

    The HOA has confirmed receipt of all payments she has "claimed" to make ... which is substantially less than owed.
