    I have already seen the email thread which was attached.  I have signed documentation from Celebrate Settlements which is not included in the email thread which clearly indicates that they owe me $1000.  If this complaint is not sufficient I will proceed with filing a lawsuit. Please see the attached documents.  All provisions have been met for release of the security deposit. to reimburse me the $1000 security deposit. The business has not made any legitimate attempts to resolve the problem. They have refused to return my $1000 security deposit. Please assist in the return of my security deposit.

    Please see chain below. ****** ******* failed to pay the buyer funds that he acknowledged was owed per the terms of the sales contract he entered into with the buyer. He admitted he owed the funds but refused to pay. As a title company, it is the company's obligation to pay parties per the terms of the written agreement signed by the parties. The buyer was paid with the seller's post settlement occupancy funds held in escrow.

    However, with all due respect, you cannot hold his security deposit. The occupancy agreement between the buyer & seller is separate from the attached document.     ********, for clarity, *** ******* signed the attached document at settlement agreeing to pay any and all outstanding amounts owed per the terms of the contract he entered into with the buyer, even if the amounts owed are discovered after the settlement or not reflected on the ALTA signed at settlement.  All parties agree that *** ******* owes the funds.  Please advise whether he intends to wire the funds to the title company.

    As a follow up to the conversation, after reviewing the closing disclosure from the buyer’s lender it appears the difference of $534.87 *** ******* identified is the escrow payment due on the buyer’s mortgage.

     The principal and interest payment is $2962.33 as reflected on the ALTA *** ******* signed vs. the $3497.20 on the buyer’s lender closing disclosure, which includes the escrow amount of $534.87.

     

    ******** and *** *******, please advise whether the post occupancy agreement amount was to cover the principal and interest payment only in the amount of $2962.33 or was it to cover the  principal, interest, taxes and insurance in the total amount of $3497.20.
