    I purchased a Remington 870 shotgun from this seller from ********* online auction site. I received a small, youth model instead, the seller reported an "honest mistake.' Thought with strict Federal **** firearm regulations, I really doubt this is likely to happen unless pure poor oversight. Seller wants me to return shotgun, but refused to make up for this mistake by reimbursement of my expenses: shipping, state tax and FFL transfer fee. Apparently seller wants me to eat my expenses for his misrepresentation. There is also the possibility of US postal fraud and this is being looking into. I have filed a claim with my state ************************* and have forwarded a copy to ************. I will return for the cost of the shotgun, but it is only honest and fair that I be also given back my expenses. I trusted this seller in good faith before, but I will not again.

    Hello.. the firearm was sold on (08/19/24) a Remington 870 20 Ga on Gunbroker and shipped to a federal firearms licensed dealer (08/22/24). The customer is required to vist the *** and inspect and do a background check. The customer received and took possession of the firearm. On 08/24/24 the customer contacted us to inform us the firearm is a youth model not a standard model. Emails went back and forth with ideas to fix the issue however the best option was to send the firearm back and we would provide a shipping label to do so. This is standard return policy for customers not happy with their purchase. The customer wanted us to refund his purchase then he would ship the firearm back. Unfortunately we live in a world that is not possible.

    I am rejecting this response because:

    Sirs,

        The issue is NOT that I will or will not return the misrepresented item.  I will be happy to do that with their return label.  However, that action still stiffs me for the additional expenses I incurred dealing with this dealer.  Simply returning the item for a refund of the purchase price does not make me whole--that is, by their deception, I am out approx. $123.00--by returning the item for purchase price means I end up getting scammed by this amount.   I am just a customer who was was taken by this incident, and $123 might seem minor to them, it is not to me.  This is simply not right.  If they were in my state, I could easily take this matter to limited actions court and I am sure a judge would realize that they are in fact, by their misrepresentation, at fault for these expenses. 

         I find it very difficult to believe any legitimate, honest business, would even hesitate to make things right after their own admission to their misrepresentation.  As it is, my recourse is to appeal to BBB to help find resolution to this problem.  They say "this isn't the world we live in."  I don't know about how they live their lives, but  in the world I live in you make up for mistakes and try to do the honorable thing and make things right.  The dishonesty here is astonishing.

    This dispute is NOT resolved.  The business is willing to refund for the item, but neglect to refund for the original shipping, the sales tax and the *** transfer fee I had to pay for the fraudulent transaction. It seems that the BBB always sides with the business when such issues occur, and the consumer gets stuck with loses.  BBB accepts the responses from the business but seems to ignore the other issues which hurts the consumer.  They responded, but didn't give a hoot for my lost money.  I wonder why I even bother with the BBB resolution process.
