    I am retiring from the Air Force after 21 years of service. Since I am retiring I am moving. I took my retirement orders to the leasing office at Dorsey Ridge. I was told I could not break my lease because they are not PCS orders. I was told that retirement orders are not covered by the Service Members Civil Relief Act (SCRA). I believe this is a clear violation of the Service Members Civil Relieve Act (SCRA). The apartment complex is not allowed to make more stricter rules than federal law. I do not want other service members to go thru what I am going thru. Military orders allow a service members to break their lease, whether it is PCS, retirement or separation. I want the apartment complex to honor my service and allow me to break my lease. I have attached my lease and my retirement orders.

    We received retirement/separation orders from Mr. ***** in July 2022. Mr. ***** informed us he planned to vacate the premise in August 2022.

    Upon review of the orders, we learned, the separation/retirement orders are not effective until June 2023. Mr. ***** is requesting to be released from the lease 10 months prior to his separation orders. Please note, the current lease between the Mr./Ms. ***** and The Villas at Dorsey Ridge expires March 13th, 2023. Yet again still, 3 months prior to Mr. Whites separation orders. Attach is a copy of the orders.

    We appreciate Mr. Whites service to our country. And as a compromise we extended Mr. ***** the following offer: Should Mr. ***** choose to proceed with vacating the premise as of August 31st , 2022 we will immediately market the apartment to get it re rented, Mr./Ms ***** will be responsible for rent until the apartment is re-rented. Mr./Ms ***** did not respond to this offer. Attach is the email presenting this offer.

    The Service Member Civil Relief Act is intended to relieve service members from legal contracts so they can either return home after separation or server under PCS or deployment.

    It is important to note, we have been made aware that Mr. ***** is attempting to move to a nearby apartment community. We learned this information after receiving two rental verifications request for new housing applications. One in Laurel, Maryland located 8.5 miles away for The Villas at Dorsey Ridge and the other in Annapolis, Maryland, located 18 miles away from The Villas at Dorsey Ridge. Attached is a copy of those verifications.

    As of today August 31st, Mr./Ms ***** have indeed vacated the apartment and surrendered possession.

    For the reasons above, we feel our offer is a fair compromise.
