On 6/22/24 I had rented a hall at this facility for a party of a 100 guest. Starting when I signed the contract ( 2/13/24) I had mentioned to Mr. ********* that in June is a very hot month and to please had the building air conditioner check and running. On the day of 6/22/24 there were to events one in the blue room that held over 300 guest and the red room that held 200 people. I rented the red room I called Mr. ********* about 12:45 pm to let him know that I would be there by 1 pm to set up I also mentioned that it was very hot already outside and the temperature would reach 98 degress on 6/22/24. He laugh made jokes. More guest arriving and the other party guest arriving and they complaining about the air conditioner and that it was not blowing in the blue room either. The maintenance person called Mr. ********* several times and he did not answered. I told my guest that the air conditioner is not working and if they need to leave because of health issues and that it was to hot in the building I understand. Maintenance person and I tried to figure out why the air conditioner was not blowing air. The blue room guest took chairs outside to cool off, I went out to purchase 7 fans to see if that would cool the red room down it did nothing. By 8:30 pm guest started to leave complaining that it was too too hot in the building and that it was becoming a health issue for many because this was a party of 65 and older seniors. I began to text Mr. ********* about the matter letting him know. Mr. ********* was neglect in not helping with the matter of the air conditioner that day. He ignored the importance of the air conditioner running properly for a hot hot day 6/22/22. I'm asking for a return of $1000 for the down payment of renting the hall and be reimbursed for 7 fans purchaused by me because Mr. ********* was negligent in checking the air conditioner unit and he knew on 6/22/24 that the hall was gathering about 400 people between the two rooms.

    Business Response

    Dear Dispute Resolution Team,

Thank you for your letter and for giving us the opportunity to respond to the allegations surrounding the event on 6/22/2024.This client only contacted us on the day before the event indicating that the temperature will be 95 the next day. We acknowledged and informed her that if she wishes to postpone her event because of the anticipated upcoming high temperature, that we will honor it but that our HV** has been serviced and in good working condition. We did not have any issue with the system before her event date.  On 6/22/24, the ** system was cooling as expected. At around 8:30 pm at night, one of her guests attempting to reduce the temperature below 68 and broke the thermostat/the HV** system and the system shut down. I went and brought fans and requested that they close the party since the ** has collapsed, but they refused. Their event continued and they stayed until the end of their time per the contract.

As you may be aware, this summer is like no other in terms of the temperature throughout. Almost all the event centers and hotels in the area experienced similar issues.
Even after June 22, 2024. I have spent approximately $30,000 on the HV** system trying to fix what their client broke. It is not clear if they broke it intentionally or by accident. If you call must **** company, you will find out that it is not something that any company can fix in a day or even a week. It has been fixed (to God be the glory) but before it was fixed, when we call our clients to help them find a new location, some of them gets angry and refuse to move but then on the event day they still blamed/threatened us.
Let me know if it is okay to call this client and work with her to reach a resolution. I can take the fans if she has the receipt. Once I confirm where they bought the fans from and how much they paid for them, I can reimburse her for the fans. Regarding the cost of the hall rental, they stayed till the end of their event per their contract.  However, I believe you have had more experience with client-business disputes, therefore I would like to seek your advice on how to resolve the second request to pay her some of the rental money back. I sincerely wish that they reached out to us directly for resolution first before contacting your company. The client never sent me any letter nor contacted me after her event. We communicated via text message throughout, but I did not hear again from her after the event. I thought she was afraid that I may sue her for breaking my HV** system.
Thank you for all that you do in mediating to help resolve this case. I look forward to your advice/recommendation.
    Sincerely, *******.

I am rejecting this response because: Mr. ********* lied in his response to BBB
I had mentioned to him when I brought him my balance deposit to him 2 weeks before the event that the temperature in June is very hot and to please have the air condition running properly he laughed. He never mentioned to me and my sister that I could postponed the event. He did not have fans there I asked the attendant that was on site. I purchased all fans and the thermostat was showing 85 degrees by 6:30 pm.  Mr. ******* the attendant open the air condition box to see if he could find out what was going on with the air.  The other party in the Blue room was there before me and my set up people arrived the DJ from the Blue room complain to me that the air was not working.  I called Mr. ********* that day (6/22/24) around 12:30pm letting him know that I was on my way there to set up and mentioned to him that the temperature outside was hitting 95 or more and please to have the air working properly.  I and Mr. ******* called Mr. ********* that evening several times on 6/22/24 and he never answered his phone he did not call me that night or the next day.  Mr. ********* is a liar in his statement to BBB, if anything was true why would I had contacted BBB. Mr. ********* is bias and he thinks dealing with a black American woman are people he can step on.  No I or any one at my event did not broke the air condition the air condition was already broke when both events Blue room and the Red room events was taken place. I willl never recommend this Hall to anyone for events.   I do not need a second response from Mr. ********* he is a scammer/liar and I will close this case as of 10/5/2024.

    Regards,

    **** *****
