      I've already resolved one issue with this business where they overcharged me and provided a refund but yesterday they tried to take $347 out of my account even though I've been removed from their program. I thought this issue was resolved but they continue to try and take money out of my account. I want them to stop attempting to take money out of my checking account.

      Good morning, 

      This complaint is simply not true.  We have dealt with this issue from this client before, and even then, she had no proof, and she was trying to scam us out of money.  Regardless, we gave her a refund of the payment she made to us, and she was cancelled from our program.  On top of that, she agreed in writing that the issue was solved.

      Now, a month later, she is claiming we tried to pull a payment from her, and she wants to sue us for money.  This client's information has been deleted from our system and she was cancelled as a client.  We don't have any of her banking information on file for us to even attempt to pull a payment.  

      There is no bank statement from the client to prove her complaint.  The client doesn't use a real bank, they use **** *** to make payments.  The screen shot that was submitted by the client doesn't actually show anything happened and a screen shot from the **** *** software isn't real or regulated.  We have asked several times for an actual statement that shows where we have tried to pull money, and that has never once been provided.

      We have attached our internal file that shows the only transactions that have ever been attempted and finalized with the client.

      Again, this client has been known to do scams in the past, won't provide an actual statement that shows any wrongdoing, and is now submitting a false claim trying to scam money from our company.  We have provided our statement that clearly shows we have not attempted to pull any payments from this client since they were enrolled with us.

      They just attempted to take ANOTHER $347 out of my account today, so that is nearly $700 in total. I did NOT sign anything even though at one point they said they wouldn't provide a refund without me signing. I did call to report their request for me to sign an agreement before they would issue a refund but I DID NOT sign anything. At this time I am NOT asking for a refund of any sort as they were not able to take money out of my account. What I am asking for is that they stop attempting to take money out of mt account. I do not want to have ANY part of their program, I just want them to STOP attempting to take money out of my account. I have provided screenshots of my account and statements.

      Per the agreement, I was to pay $297 on the 10th of May, which I did and then it was to be $247 on the 10th of every month thereafter. However, on the 25th of the month, they took ANOTHER $297 from my account. When I attempted to resolve this issue, First Choice Auditors claim they did not receive a payment from me on the 25th even though I provided documentation to show that they had, in fact, double charged me for May.

      Good morning, 

      This complaint is false, and the documentation that the client provided to us proves that.  We attached their Cash App statements that they provided to us to this reply, just to further show what happened.  The complaint against us states that we charged the client twice, when in fact, we only charged them once.  The statement shows multiple attempts by us to charge the client, but they were all voided out and not authorized, and in turn, no money was withdrawn from the account.

      You can see on the statement where there is only one transaction to us that is authorized.  The others were not authorized and in turn, they never went through, and the client was never charged. 

      We confirmed with Cash App that only one payment was withdrawn from the client and that all the other charges listed on the statement were not charges that money came out, because none of them were authorized.  They also confirmed that the only time money actually comes out of the account is when it says authorized on it.  The statement that the client provided to us, which we attached to this reply, clearly states that only one charge to us was ever authorized, and all the other charges associated with our company were voided and no money was taken out of the account.  Also on the statement provided to us by the client, you can see at least 4 other instances of where there was a charge for something, but then the client didn't authorize it and it was voided and no money was withdrawn from their account.  

      We ask that this complaint please be erased as it is a false accusation and we have proven with the clients own Cash App statement( Cash app is the bank they were using for this charge) and confirmed with Cash App, that only one charge to us was ever authorized.

Can someone please advise me on how I should proceed?   The call that I received from **** at 10:06 am this morning seems to conflict with the written response.  Please advise why the conflict information.  Please also provide a complete accounting of all payments made.

      To whom it may concern, 

      This complaint isn't one of opinion, it is about facts.  Below are the facts:

      - The client states they were charged twice, and we only charged them once.
      - The client hasn't submitted one document that actually shows either two authorized charges out of their account or a statement that shows their balance being debited twice.
      - The documentation provided by us and also by the client both show only one debit that came out of their account.
      - We have openly told the client that if they can show proof that two debits were taken out of their account, we would gladly refund both.
      - We have already refunded the client the one payment that we did take.

      All we ask is that if the client can't provide any actual proof to back up their complaint, that this complaint be removed.  If the client can provide an actual statement that shows money being debited twice (again, they have yet to do this), then we will gladly refund them.

      I paid this business 422.00 a month beginning May 2022 and ceased paying August 2023. They agreed to help me to reduce large credit card account debts that were compounding in interest. Two of them were **** ** ******* debts as well as one ******** debt totaling $34,200. I agreed to pay them $15, 489 over 3 years. They would negotiate with my creditors. I would pay them. My debt would be forgiven or negotiated by the end of the terms. If they got it forgiven, then I'd not have pay anymore. However, to my surprise I received court documents stating I was being sued for the total amounts, which I was instructed to uploaded into their server. They said they had a lawyer on retainer and made me agree not to reply or go to court. They assured me they would represent me in court and explain that we were negotiating terms and work out a settlement. However, I started to doubt they were acting on my behalf and asking questions when I never heard any terms. Finally, they offered me a settlement that was close to what I would have paid without them on my own if I used the 6,000 I had already paid them. They did not even attempt to negotiate 2nd debt with ********* and aggressively tried to persuade me to continue ongoing payments of $220 month to try and settle that in spite of the failed **** ** ******* reduction. When I questioned , why would I continue to pay them when they did not do what we agreed to they became nasty. They told me that I misunderstood and it was all my fault. They offered me 2,500 if I signed a document allowing continued payment to settle with ****. Even when I said our agreement is over since **** ** ******* had gone to court, they still billed my bank. I had to change my account and threaten them to stop debiting my account unlawfully without an agreement. I refused to continue working with them and they said they are not giving me a penny back towards my debt and will cease all communication with me. However, originally Cecil Rolle, the man who explained the program originally , who was never to be spoken to again, promised me that any money I paid them would be applied to my original debt once it was settled and that was like a savings account. Needless to say this has caused me extreme distress.

      At the end of August, I felt like something was wrong and they tricked me and ruined my credit that was in good standing. Before I signed on with them, I never missed a payment in my life. They told me that for this program I could not speak to the credit card company at all. Do not respond to any phone calls and upload any paperwork that I got in the mail. I did exactly as they asked because I believed this was the proper channel to get the debt forgiven or in half. My credit score was ruined. The sad part was that it actually was worse after I signed on with them. Believe it or not, I contacted another lawyer named ******** ****, and his law office was supposed to be representing me in getting my money back and negotiating the debts with **** ** *******n and *********. As I expressed my concern and worries that the first lawyer with FirstClass Auditors may have not really communicated with the court, etc. I didn't want anything on my pemanent record. I paid his law firm 2, 500 to represent me as a flat price. I called estimate 4 times to inquire how negotiations was going. Did he get in touch with FirstChoice Auditors. They again put me on the back burner and said the negotiations go back and forth and that I had to be patient etc. They said they throw out a number and go back and forth. Well, today about 3 months later, my paycheck was LEVIED by **** ** *******. The court took my full paycheck and I am left without a penny. I have bills to pay, medical surgery for my daughter next month and a full deposit to make, a mortgage to pay and 3 children. I don't know what to do. I can't afford a another lawyer. My paycheck was $3700. The debited $6000 from my account. And, my 2nd lawyer's flat rate was $2, 500. I am out $12,000 because of this scam. Please tell me if you can help me with this. Apparently their is a lawsuit filed on 8/29/2023 - Maryland District Attorney against this company for false advertising and making people like me believe this was based on relief fund from Covid, etc. This is absolutely true. That is why I trusted them. Their name brings up other credit card companies that have 4 stars. This is fraud. They tricked me, purposely misrepresented themselves and made me believe it was a federal back program. Please tell me what you can do to help me.

      On the second to last communication with their supposed lawyer , he was going to contact the **** ** ******* debt and offer to send 2,500 - 3,000 of the money I paid them in “escarole” to get a lower amount for a monthly payment. But since I said I was not going to sign in to continue paying them for ******** account that they were originally hired to settle and get a reduction. They did not finish the negotiation with **** ** *******. Their work with **** ** ******* was over at that point they said because it went to court they said and there was a judgement. However, I am not even sure if they ever contacted **** ** ******* debt. I don’t believe they spoke on my behalf in court. They told me don’t respond and do not call Court because they are solely responsible to represent me.

      Now, my bank account is frozen. How is this legal ? It’s their fault that it has escalated to this level. They misrepresented me and lied to me about going to court for me. They never gave me any information about the proceedings except not to worry about it. 

      The whole contention started when I asked them why the debt was not decreased and what would happen with the $6,000 I paid them to not do anything to improve my situation except to destroy my credit.

Additionally, the company has reached out and is in the process of issuing a full refund for any inconvenience regarding our services. Unfortunately, this company has no relationship or connection with the "second attorney" mentioned in the original complaint. Therefore, this company cannot respond to those portions of the complaint. Please let me know if there is anything else you need from me to resolve this complaint.

      The business apologized for the "miscommunication"  and sent me a check issuing a full refund for the original $6000.00 paid for their services.

      Please remove/rectify the complaint at your earliest convenience. The law firm mentioned also came through with their services agreed upon as well.
