Ms. ****** entered into the loan with Personal Finance Company (PFC) on December 1, 2015. PFC was later acquired by Mariner Finance, LLC (Mariner).
Regarding Ms. ****** allegation that Mariner violated the Fair Credit Reporting Act an initial disclosure regarding credit reporting in the **** Act Notice and in the Privacy Notice, both of which were provided to her at the time the loan was originated, and annually as required by law. To further clarify, credit reporting is clearly identified in Mariners Privacy Notice, and in 15 U.S. Code 6802, as a type of sharing that cannot be limited by a consumer.
Reporting accurate data is an essential obligation of data furnishers under the Fair Credit Reporting Act. Mariner makes accurate account information available to the ************************* (CRA) on a monthly basis, and each CRA has its own internal policies that determine how the information is displayed in the credit report and for how long. I am filing a complaint due to an error that has been made by ***** **** at Personal Finance/Mariner Finance. I have been making $50 pymts on my account since October 2020. I have a call record to verify that I left messages with Ms **** for May 2022, June 2022, July 2022, and August 2022 pymts asking her to please use my banking information on file to make my $50 pymt. She never applied any of these month's pymt to my account as I had requested. I left a message Aug 2022 questioning Ms **** as to why she had not been deducting my $50 pymt from my checking acct information she had on file and asked her to please take $50 for Aug 2022 pymt. 9/12/22 I called Ms **** regarding the pymts that she had not been applying to my loan balance. Ms **** confirmed that she had received all of my messages that I had left requesting her to make my $50 pymts. I asked her why she had not taken out my pymt for my loan. Ms **** disregarded my question and asked if I wanted to make a pymt today and I said yes. Ms **** took my $50 pymt at this time. 9/14/22, I received a small claims summons to appear in court due to non-pymt on my loan. I had no words. I have been making my $50 pymt to Ms ***** **** each month since Oct 2020. I never stopped making my pymt. Ms **** failed to apply my $50 pymts. I called Ms **** on this date and asked her what she had done. Ms **** stated she was not going to lose her job over me. I asked her what she meant. I asked to speak to her Supervisor as Ms **** repeated herself about not losing her job over me. I was transferred to Shirley who was as rude as Ms ****. Shirley questioned my monthly $50 pymt. I told her that was the agreement Ms **** and I had made Oct 2020, 2 years ago. I asked to speak to someone who could help me with this error. Shirley provided a phone # to an attorney rather than me speaking to anyone else at Personal Finance. I never once stopped making my pymts. This is unjust and has caused great me great distress. Thank you for contacting us with your concerns. Mariner Finance, LLC ('Mariner") takes customer concerns seriously, and our Customer Relations Department has thoroughly researched this account.
Ms. Rodgers entered into the loan with Personal Finance Company (PFC) on August 26, 2016. PFC later rebranded to Mariner. The executed contract required one (1) payment of $172.17 and thirty-six( 36) payments of $150 with an original maturity date of October 3, 2019. Because the account remained past due for the March 3, 2018 contractual payment obligation and no payment arrangements had been achieved, Mariner initiated legal action to collect the account on February 21, 2019. Ms. Rodgers contacted Mariner on October 14, 2020 and agreed to make payments of $50 or more per month to avoid continued collection attempts.
Mariner has agreed to accept the remaining balanced owed minus additional fees as a courtesy, however we request all payments be submitted to the handling attorney. We have communicated the proposed resolution to Attorney Heavner who will in turn discuss with Ms. Rodgers.

October 14, 2020, I entered into a verbal agreement with Vicky Hill to make
$50 payments each month which I have been doing. The small claims
summons case was dismissed on November 16, 2020. For whatever
reason, Vicky Hill chose not to accept my payments as of May 2022 of this
year.. This error has been acknowledged and recognized by Mariner
Finance/Personal Finance.
Regarding the conversation with Keisha Mariner Finance Customer
Relations on October 14, 2022, I again agreed to continue paying off this
debt as I have been for the past two year, however I did not realize that
when speaking to Keisha they would not be dismissing the small claims
summons they have brought against me due to Vicky Hills error is
accepting my payment and applying it to my account. I do not feel that I
should have received the small claims summons and reached back out to
Keisha on this same day with my concerns.
I called October 22, 2022 to request a $50 payment be applied to my
account however Vicky Hill Mariner Finance Personal Finance chose not to
accept this payment.
October 31, 2022 I returned a call from Keisha Mariner Finance Customer
Relations. Keisha was questioning the response I made to BBB on October
15, 2022. I wanted to report on the issues I have had over the course of
several loans through Personal Finance and the extra fees that were
charged to me at each loan until I questioned it. Keisha did not understand
the concerns that I had in regards to Vicky Hill not accepting my payments
and how I was served a small claims summons. I had concerns regarding
the fact that there was no mention of my account being sent to collections
when Vicky Hill accepted a $50 payment from me on September 12, 2022.
(Small claims summon was received on September 14, 2022). Keisha
stated our conversation was going nowhere and I agreed. Keisha told me
that I was a grown adult woman who could have found other ways to make
my payments. I reported that I had on several occasions asked Vicky Hill
about other options of making my monthly payments however Vicky Hill told
me that my only option was to make my payments through her.
I have concerns that my account was sent to collections in order for
Mariner Finance Personal Finance to begin collecting interest on my
account after they had closed it. There is no other explanation as to why
my payments were not applied to my account as I had requested. I made
three calls in June 2022, two calls in July 2022 and three calls in August
2022; now two calls in September and one call in October. Keisha told me
that I should take responsibility for my payments. I consider this my taking
responsibility for trying to get this account paid off.
If I had not been trying to make my payments each month since my verbal
agreement with Vicky Hill Mariner Finance Personal Finance then yes
submit a small claims summons. Vicky Hill has acknowledged receiving my
requests. I have no control of Vicky Hill's job responsibilities however I do
believe her job was to apply my payments to my account as I had
requested.

Ms. ******* entered into the loan with Personal Finance Company (PFC) on August 26, 2016 with an original maturity date of October 3, 2019. PFC that later rebranded to Mariner Finance, LLC ("Mariner").
With the account past due for March 3, 2018 and multiple failed attempts to contact Ms. *******, legal action to collect the account was initiated on February 21, 2019. Once legal action is initiated on an account, the account remains a legal account. With the account remaining past due, the legal action will continue until judgment is granted by the courts or the customer signs an agreed judgment.
It is the customer's responsibility to make payments as agreed upon. The inability of a customer to achieve direct contact with any particular individual does not relieve the customer from their responsibility to make the agreed upon payments outlined in the executed contract. I entered into several loans with Personal Finance Company and I do not believe the date you are referencing is correct. I have contacted Personal Finance / Mariner Finance and requested a copy of all loans and transactions that were made for a couch, bed and three $500 loans.
I did not receive any communications from PF/MF once it was brought to their attention about the hidden fees that were applied to my loans. There was a $281 credit to my account but that did not cover all of the hidden fees totaling $1100.
I reached out to PF/MF to begin making payments in Oct 2020. The legal action that I found out after the fact was dismissed. Williamson County Clerk verified this to be correct. The only reason there is a legal action against is per Vicky Hill not making my payments to my account as requested.
The company should provide other options of making payments. Vicky Hill did not answer the phone and her voicemail was full most of the time. I spent quite a bit of time trying to make my payments. I work and do not have the time to call everyday hoping Vicky Hill will answer my call. The company has an obligation to their customers as well. Vicky Hill provided one option for me to pay and it was through her. If my online account could have been open then I would have not had to leave messages with Vicky Hill when she did not answer the phone. It was also difficult when her voicemail was full all of the time.
I have been in contact with PF / MF, their attorney as well as Vicky Hill Collections and Keesha Customer Relations to try to resolve this matter. As I stated previously, I have been requesting and making my payments each month until for some reason Vicky Hill stopped accepting my requests for payment.
The lawyer postponed the court date to next month stating we were working on a resolution. As of 11/14/22 there has been no communication from anyone regarding a resolution. There is no resolution if I am expected to agree to a judgment that has been falsely made against me.
Upon review of past business transactions with others regarding similar issues as mine with PF/MF, I made a complaint to the Attorney General. The company had a class action lawsuit against them for hidden fees that I was not aware of.
Due to the emotional harm that has been caused by Vicky Hill and others at PF/MF by accusing me of not wanting to or failing to make my payments, I plan to seek damages. I was falsely accused and that resulted in a summons. This situation has caused me great stress and continues to do so.

Although legal action was initiated February 21, 2019 and recently progressed due to having not received payments as agreed upon, Mariner has decided to put legal action on hold and waive the current legal fees while continuing to allow Ms. Rodgers to immediately resume the agreed upon payment arrangements. In the event Ms. Rodgers stops making the payments as agreed upon, Mariner reserves the right to continue the legal action that was initiated on February 21, 2019. In order to avoid any miscommunications, Ms. Rodgers needs to make the agreed upon payments directly to the collection attorney at Heavner, Beyers & Mihlar, LLC *** E ******* *** ******** ** XXXXX. I've never heard of this company nor been contacted by them, but they have flagged my Experian credit report for collections 3 times in 3 weeks. All my bills are paid in full every month.
