    1. I signed a contract with ARH Decks to install a deck and fence and included the HOA requirements well before the beginning of construction. They did not install the gate as agreed and did not comply with HOA.

    2. They didn't center the gate and the gate swung outward, which is not HOA compliant. ARH Decks and I went back and forth through emails, texts, and calls over the next couple of months. I was persistent and patient while trying to remedy this situation. Then, my decking cracked and that's when I noticed the crew that installed the deck damaged the siding on my home and attempted to fix the issue by screwing the siding to my house. Eventually, they used the same gate, flipped it around, and now my gate is backward and swinging inward.

    3. I was informed that "If I want to pay (name) time and any materials I am welcome to use him." According to my contract Warranty, "The Contractor warrants to the Owner that the work performed in connection with the Contract will be of good quality and workmanship, free from patent and latent defects, and will conform to all federal, state and local laws and regulations. The Contractor shall warrant the work performed under the Contract for a period of three (3) year from the date of the Contract. The Contractor's warranty excludes remedy for damage or defect caused by abuse, alterations to the work not performed by the Contractor, improper or insufficient maintenance, improper operation or normal wear and tear under normal usage. The warranty provided herein shall be in addition to any manufacturer warranty or other warranty which is passed through from the Contractor for materials used. Contractor shall provide Owner with copies of any additional warranty. if someone other than ARH Decks."

    My persistence to correct this situation was met with deflection, excuses, and a lack of professionalism. They never took ownership of their mistakes and didn't show any remorse. I shouldn't have to pay double for their incompetence.
