On June 6, 2022 I employed Accutech pest management to treat carpenter ants. They applied treatment, I signed and they told me they suggest I reapply with them in 30 days and quarterly thereafter. Without my knowledge or agreement, the technician signed me up for a recurring service using a more limited and general set of chemicals that would also harm honey bees and other insects in my yard.
While on vacation a month later, and without any phone call or confirmation, this service was applied to my yard. After getting confirmation of what was applied, and where, the owner insisted I owed them for this service despite NOT requesting it, and NOT desiring it. He did not believe that this was signed up against my knowledge. He immediately sent the bill to collections.
Although i realize it would be difficult to prove that the technician used my signature for the recurring service without my consent, I CAN prove the following:
      1. The contract i was sent states the company will attempt to call me to set up treatment. There is no record of any attempted phone call to confirm the treatment before it was applied.
      2. The contract has an invalid start date (see attached)
      3. there is no reasonable explanation of why I'd want a different service than what was applied initially, particularly since the property has free range chickens and garden that benefit from honeybees.
      4. After both the first and second application of these chemicals, i still have carpenter ants and can provide timestamped photos. https://photos.app.goo.gl/usbUa1vm7svk4n7u7 As far as I can tell, this business is not only corrupt, they are inept.
      5. The business should take responsibility for resolving the debt collection attempt and expect no payment from me. If not, this business can expect I will sue and account for the time taken to generate this evidence for their fraud/breach of contract. Hoping the BBB can resolve.

Please let me know if you require any more information.

      Business Response

      Date: 11/02/2022

      Business Response /* (1000, 5, 2022/08/24) */
Mz. Sill employed our services in June for an ant problem. It is our company policy to NOT do any one time services for ants due to their persistence. The technician offered a contracted service with a guarantee that included ants and it was accepted. The contract does allow for contact prior to services being performed but that is at the customers direction and we were not directed. We performed the 30 day follow up as is standard practice. On July 11th she called to cancel the service. I offered to allow her to cancel the contract if she paid for the services that were already performed. She was not open to any compromise. As a company practice, the account was sent to a collections agency to mediate.

In response to her specific claims: 1) She did not direct us that she wanted the contact option. 2) The contract was initiated on June 6th with the initial service. 3) I can not explain any individuals motives for wanting or not wanting a service but we initiate them everyday. 4) The reason we don't do One time services for ants is because we know that one service will not solve a problem. Thus we are transparent and competent. 5) I attempted to resolve the collection without any hard feelings and am justified in asking for payment for the complete contract. However, I am still willing to part company with the $120 outstanding balance being satisfied.

It is our hope that Mz. Sill finds a satisfactory solution to her ongoing ant challenges.

      Consumer Response /* (3000, 7, 2022/08/25) */
(The consumer indicated he/she DID NOT accept the response from the business.)
No attached evidence were addressed whatsoever. BBB, I request your help holding this business accountable.

Their technician absolutely DID NOT tell me he was signing me up for a recurring service. Previous ant treatment by a competitor lasted 3 Years with a single application, so I would have had no interest in a less effective upsell that would harm pollinators and free range chickens on the property. The contract they claimed I "signed" they aren't even holding themselves to, as it promises to contact customers before applications. I proved they did not. The contract also starts an invalid date, and I expect that would nullify the claim even if i can't prove the what i know to be true about what the technician did/did not tell me on the original day of service.

      Business Response /* (4000, 14, 2022/09/21) */
Mz. Sill is unwilling to own her responsibility in the matter. Accutech Pest Management has tried to proceed in good faith and was only met with hostility. Since we have a signed contract, the original offer to settle is removed and we will seek the full amount of the contract plus collections fees.

      Respectfully,
      Ron ******
      Accutech Pest Management

      Consumer Response /* (4200, 16, 2022/09/22) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The technician sprayed unwanted chemicals on our property without our consent or notice. We got not no apology, and a demand to pay for their mistake. Who is "hostile" here? Accutech didn't even honor the contract you claim I "Signed". If Accutech called to confirm the general spray of our property it could have been avoided even with the tech's mistake. BBB, please review the evidence and weigh in.
