    As agreed via text and the contract, materials were included in the total contract cost. Once Gary ******** (** henceforth) on behalf of Excellent Contracting received and deposited the first installment of $7K from me, he insisted that materials were not included.

    ** fired the crew and later rehired them. They ultimately had done a terrible job on the molding. Many other defects were also found.

    The crew he sent back over several times to rectify the defects in the job did not perform their duties by not correcting them appropriately, if at all.

    ** never came out, not even once, to the job site to review his crew's work, even though I had continuously expressed many concerns.

    As a novice, I had to manage the job myself because of **'s absences from the project with lists and sticky-notes of defects and incompletions for the crew to address.

    The job took five months before ** abandoned the project. Even after five months, it was incomplete and unsatisfactory.

    ** never took out a Howard County permit for the job as required by law and per his contract. The job remains uninspected by the County.

    Excellent no longer has general liability insurance as of September 2022 due to its non-payment of premiums.

    ** has taken zero accountability for anything, and always pointed the finger at me, his customer, with irrelevant and outright false claims.

    The only time ** reached out to me was for money. I had to reach out to him every single time for scheduling, defects, etc. He even dodged my calls, texts, and emails because of my persistence with completing the job.

    I have lost all confidence in Excellent Contracting with my beyond unacceptable and extremely frustrating experience. ** and Excellent's history as shown on the Better Business Bureau website shows a very similar experience and complaint to mine, which solidifies my case.

    I will do arbitration for free thru MHIC> I have decided NOT to participate in Binding Arbitration to resolve my complaint with ID 20132242,. I understand that because I have decided to not pursue arbitration that BBB must close my complaint. I have decide to pursue legally or via other avenues.

    1. TIME IS OF ESSENCE and as such should be enforced even if it is not explicitly written in the contract.
    2. RETALIATION against homeowner for filing complaint against the Contractor. Deliberate delay in completion and retaliation confirmation is in text message.

    Check 2: 10,000 (Enclosed) 2nd Draw
    Check 3: 8,000 : Unable to retrieve from bank. Gary does not provide us with any receipts. 3rd Draw. Discussing with bank to retrieve a copy of the check.
    Check 4: 3,000 (Enclosed): 4th Draw, a proof that Draw#3 was paid.

    Gary promised to finish the basement by June15th, then gave a date for October the 15th 2022 and then after a mediation call with MHIC promised to finish the work by November 30th 2022. Time is of ESSENCE and all verbal and written promises must be enforced.

    Gary keeps postponing and lying about the completion of the work. When we ask him about completion he sometimes says that he fired his crew and other times he says that our basement completion work is not the only work he has.

    He has done nothing to complete the work on time. most of the work till mid of July was done without a permit. we have been living with a dirty, dusty, uninhabitable basement since March 2022.

    I would request the completion of the work immediately, my losses be recognized and compensated for as allowed under principal of justice.
