Clint Wilhoit, *****, was repairing the house foundation due to a vehicle driving into my house. This incident is a house insurance claim. Work started on 6-21-22. Clint dropped a partial concrete block onto the newly repaired copper water pipe that enters the house. He let me know about this a couple days after it happened. Clint told me he would pay for the cost to get the water pipe repaired. I asked Clint about doing a claim with his business insurance and he told me his deductible was more than what he thought would be the repair cost so he would pay directly to me the full repair cost. I gave Clint a cost repair estimate of around $500.Once I received the paperwork, on 9-6-22 I mailed to Clint a letter referencing the cost of the repairs along with the ***************** from ************* and Welding Incorporated and the *********************** totaling a cost of $537. On 9-9-22 Clint told me via text message that he would get me a check for payment of repairs when he stopped by on Tuesday, 9-13-22.Since this time, I have not received payment. I have made phone calls and sent text messages to Clint asking him to pay me for the cost repairs. On 10-4-22, Clint finally responded letting me know that he did not make enough of a profit on this job. He said he would come by and leave me a check for the copper pipe repair. However, he never did and stopped communicating with me. In this same text Clint said extra work was done; however, I disagree. The only extra item from the original estimate was stucco work which had its own estimate cost. I paid Clint the full amount of both estimates. He never changed the estimate cost or asked for additional money.There was also a saw cut that Clint admitted making into another part of the foundation that he never repaired. His estimate stated 9.5 feet from each corner of the foundation and the saw cut is at 9 feet 11 inches.At this point, all I want is the $537 from Clint. I feel that this is fair.Business Response

I completed all the jobs that were listed. And for the price that was quoted. ******* kept adding things on to the job that were not in the estimate. Such as wanting me to resurface the whole area that was repaired. I explained to her that this would be several ****s more dollars in materials and labor, she walked right past that,and assumed that was included in my price.
I had to clean debris from her Basement and her lawn, Which was not included in any estimate or bid.The "saw cut" was a 6 inch grind for a crack that I explained could be caulked by her painter. I notified her of the damaged section of pipe,AS SOON AS I NOTICED IT,and discussed with her that I might have done it clearing the makeshift supports left by the fire department. I was never sure when the damage occurred,she simply blames me because I told her about it. She has no proof or evidence that I damaged her pipe. I simply brought it to her attention.
******* then gave me a nearly $800 *****I see she has amended the total for this complaint. Which is indicative of the whole client Relationship I have had with her. I stopped communication with her because she was continuously asking For express on the job for the same money and making unrealistic request.
I performed all the duties stated in the contract and. Fulfilled my obligation to her. She has continued to contact me. Threatening me with all sorts of actions. Apparently this is one she thought she could do.. She also harassed my son as he walked to and from school.
I gave ******* a large Discount on this job hoping to build A good relationship, Unfortunately, she doesn't understand that. A contractor is only responsible for what is in the contract. And you can't add a bunch of extra Items to the contract for no extra price.. Realizing she wasn't going to understand this. I cut off communication and Wrote it off as another over zealous client.
I appreciate your attention and action on this, But as a contractor I'm not going to be forced Into doing free work because someone threatens to complain to the better business bureau. I've been doing this work for almost 25 years. And this is the first complaint that I've had.
And just as much as I would not expect A client to pay for something I bill them for 3 different times at 3 different totals....
I offered to give her a Five hundred dollar credit off of her bill which she refused. She then came back with an eight hundred dollar ***** **** a seven hundred dollar ***** *** apparently with you it's five hundred and something.... And as I said before, there's no proof that I actually caused the damage. I'm just the one that brought it to her attention. When I arrived To start the job, there was a Pile of rubble on said pipe. As there was All over the basement. And as I stated before, there was no Where in the contract That stated that I was responsible for cleaning half of her basement.
I appreciate in value all of my clients. I go above and beyond ninety nine percent of the time. I understand ******* might be upset but, I tried several times to communicate with her. Every time I spoke with her, Her main objective was for me to resurface The entire area for free. She was basically Threatening me with the damaged pipe to do Thousands of dollars of extra free work.

I'm selecting Rejecting Business Response.
Below are my responses:
1. Resurface Project: I asked Clint if he could do a type of stucco application on the repaired area to match the original concrete blocks. Said he could and gave me a written estimate cost of $852.00. The estimate I received from Clint was included in the complaint (file named: Clint Wilhoit Stucco Estimate 4-1-22). Clint has been paid a total amount of $5,171.00 which is the total of the 2 estimates that I included in the BBB complaint.
2. Debris Cleaning: I along with the assistance of another individual cleaned a large area of the basement where Clint would be working prior to his arrival to start the work. When Clint arrived he was good with the area that was cleaned.
3. Saw Cut: The painter is not a *****. The painter had nothing to do with the saw cut and it is not their responsibility to fix another trade's issue.
4. Damaged main water pipe after it had already been repaired: Clint told me he dropped a partial concrete block which damaged the main water pipe. He did not tell me as he stated in his response to the complaint "I might have done it clearing the makeshift supports left by the fire department". When Clint told me about this we had a conversation about cost of repair. I told Clint that I thought the cost of repairs would be around $500. I asked him about submitting a claim to his business insurance and he said that his deductible was higher than the cost of the repairs so he would pay the cost to repair the water pipe directly to me.
5. $800 Bill: I've never given Clint a bill for $800. My guess is he's referring to the cost of the main water pipe repair. My estimate guess for repairs was $500 for the repair and for the water department shutting off and turning back on the water to the house. I also mailed him a letter along with the plumber's and water department's cost for a total of $537.00. The letter and enclosures (receipt/invoice) that were mailed to Clint were included in the complaint (files named: Letter-Pipe Repair Reimbursement 9-6-22; Repairs Receipt-****** *********** Repairs Invoice-************* Welding Inc).
6. Threats/Harassment: I've never threatened anyone, including Clint. Nor have I harassed his son (or any other student) when walking to and from school. I've never met Clint's son nor do I know what his son looks like.
7. Discount: Clint never had a conversation with me about giving me any type of a discount. There was no discount listed on either of the job estimates that he sent to me.
8. Offered to give a $500 credit: I explained to Clint I could not accept a $500 credit on the 2 estimates (these files are also part of the complaint) already submitted to the insurance company. As I am the individual who directly paid the water ***** and ************* & ************ for the re-damaged water pipe and the insurance company is not paying for this repair as they already paid for it from the original car crash damage the reimbursement for these repairs should be paid to me. If I had accepted the $500 credit it would go to the insurance company, not me. In what Clint offered, I would still be the individual that paid for the re-damaged water pipe in the amount of $537.00. What I do not understand about this scenario is if Clint was willing to provide a $500 credit to the total cost of the job, then why is he refusing to pay me directly when he said that was what he would do?
In closing I'm only looking for the $537.00 payment from Clint for the cost of the repairs to the re-damaged main water pipe.

Everything in that response was false.
She and her husband tried to intimidate. My 20 month old,, 5 year old, and my fianc at a fair 2 days ago..... They placed themselves within our line of sight, watching the band play and stared at us, Then they proceeded to walk by her husband so close It seemed as if he wanted to bump me with his shoulder,as some sort of provocation or intimidation.
I never gave her an estimate to resurface the area to look like the discontinued Block she has on the rest of it. Stucco will not provide that type of texture.
I'm not going to sit here and go back and forth with this customer. She doesn't seem to have a realistic grasp on this and continues to be dishonest and skew critical facts. She is obviously doing this as a retaliatory measure because she didn't get free work. And I am rather disappointed with the whole process that someone can just write in to you and make up a situation and it counts against my business.
I'm not going to be blackmailed into paying money. Because someone wants to intimidate my family or slander my business especially for something I may or may not been responsible for,and after being given 3 different prices to fix said problem.I feel as though she is being dishonest and vindictive.

During the entire complaint process I have not said anything that is untrue, attacked Clint personally with false words, or created fictitious events.
The event that Clint wrote about the fair is not true. He did not see me with my husband at any fair or anywhere else. Nor have I ever met his family or know how many members are in his family. What he described never happened.
All Im asking for is that Clint pay me for the damage to the main water pipe in the amount of $537.00. This is what is fair.
