    On June 10th, 2024, I contracted with Scesny Roofing for a new construction roofing job for a barn at my home in **********, ** (copy of signed contract is attached). I paid an initial deposit of $5625.00 (pdf copy of the cashed check is attached) with the understanding that they would start work in late July or early August. On August 6th, two days before they were scheduled to start work, Scesny Roofing contacted me demanding an additional $6800 above the original contract price or they would refuse to do the job. Despite offering to pay half of their proposed increase ($3400) they would not honor the contract. Scesny Roofing never completed any work on my property, but they refuse to return my deposit money ($5625.00). In addition to the signed contract, I have a series of emails between Scesny and myself that clearly document the agreed upon scope of work and total contract price. Despite all this, Scesny Roofing reneged on the contract. I have since had to locate a different roofing contractor at significant cost in time and money.

    I have left several emails and voicemails requesting the return/refund of the $5625.00 deposit that I paid back in June, but have not heard back from the business in response to my complaint.

    We did have a Contract with this customer. My Employee estimated the job and wrote the Contract but had added a large insulation package to the Contract with out charging for it. So we contacted the customer to let him know if he wanted the insulation package that we would have to add it to the Contract. We did not ask in any demanding way. The customer was seaming to try to take advantage of us and have us do a lot of extra work for free and told me his lawyer was going to make us do it through Court. So I gave him my attorneys contact info and his lawyer contacted mine and we settled on dissolving the contract and I returned his deposite through my attorney. We did not hold his money.

    FAQ

    The business owner's version of events is not accurate and fails to note several key facts:

    1) I specifically asked about the scope of work (to include the insulation work) and his estimator confirmed to me via email that the contract price included the insulation work (see attached emails, particular the sections highlighted in red)

    2) I signed the contract and paid the deposit in June and the business cashed the deposit check, thus making the contract binding.

    3) Two months later, and just two days before the roofer was due to start work, they contacted me asking for an additional $6800 above the signed contract price or they would not do the work.  The owner stated that it was a mistake on the part of his estimator, but since I had specifically asked about the contracted scope of work and been told it was all included, the business owner's claims of a 'bad day' or 'simple mistake' did not make sense (i.e. I specifically asked about the scope of work and the price and was told it was correct and included all specified work (see signed contract that was previously provided).  Ultimately, the business owner admitted that it was his company's mistake, but he refused to own the mistake and instead wanted to push the cost onto me.  I eventually offered to split the cost overage with him (i.e. I agreed to pay an additional $3400 above the contracted price) but the business owner refused.  Again, I have attached emails highlighted in red that corroborate these facts.  

    4) Because the business owner waited 2 full months to inform me that he would not do the job unless I paid the extra $6800, I was left in the lurch looking for another roofing contractor on short notice and in the busiest roofing time of the year.  Additionally, because the business owner did not complete the job as contracted, the structure sustained significant rain and water damage.  As a result of this, I ended up having to pay a much higher cost to get a roofer to do the job quickly so that I did not incur any further rain and water damage to the structure.

    5) As a final insult, the business owner refused to return my deposit of $5625 unless I signed a release promising not to take him to court for damages... a very dishonest move on his part.

    6) Ultimately, this is a mistake by the contractor/business owner that he pushed on to me instead of making it right like an honest business would do.
