      Maine Properties has recently bought *********************************. Since they have bought it, there has been instances of the septic being clogged by baby wipes. To remedy this, Maine Properties has decided, instead of identifying the unit that is causing the blockage, they will charge every unit extra association fees every month if the flushing of wipes continues. This has been an ongoing issue, and ways of identifying the unit have been proposed. However, instead of taking those recommendations, the property management company would rather charge over 60 units for possibly only 1 persons issue. They have already raised the condo association fees once to cover this, and are now going to be raising them again.

      I am responding to complaint 22278784. Maine Properties LLC manages *************************************** on behalf of the board of directors. Maine Properties does not own the association or able to make decisions for the association. When the unit was purchased, the Declaration was provided to the unit owner which explains that common maintenance is shared by all parties of the association regardless of who might be causing the maintenance issue. 

      The Declaration outlined the common area expenses that would be shared by all owners.  These are also included in the associations budget, which is ratified by the owners at every annual meeting.  Living in a condo association means sharing costs-whether you benefit from the service/element or not.  Those who dont use the pool probably dont enjoy paying for the servicing of the pool.  The same goes with water usage-one person might do two loads of laundry a week while another does 15.  They still pay the same towards water usage for the association.

      Replacing the pumps in the pump station is a necessary capital repair to ensure the ongoing success of the septic system for all ************************************************************ the past which has caused a more urgent repair. 

      Maine Properties will recommend the board educates unit owners on maintaining the new pumps to avoid possible maintenance issues.

      I was supposed to move into Winchester ***** on June 1, 2023, a new apartment complex listed by Maine Properties. After I paid the security deposit and was told my move in date, they pushed it back THREE times due to not having the Certificate of Occupancy from the City if ********. The final time being Tuesday evening at 9:24pm, THREE days before I was supposed to move in. When they emailed giving that update on Tuesday evening at 9:24pm, it was after they ignored multiple emails and phone calls for close to two weeks.When they finally emailed back Tuesday evening, they offered my security deposit back or an option to explore other locations within their portfolio. I reluctantly opted to explore options at their Scarborough location as I only had three days to find a place to live. However, they only had two bedrooms to offer and they were $600 more than I would have paid ($2,495 per month instead of $1,895). I asked that they pay the difference in rent and they told me that they would ask the owner of Winchester ***** to do so. Almost seven hours later (Essentially an entire day later. Crazy, given that time was of the essence), they responded around 7pm and told me that the owner would only pay $200 toward the first month of rent only (Meaning, I would pay $2,295 the first month and then $2,495 the following months). I understand that things like this happen with new construction. However, I would have asked for my security deposit back and found another place to live had they not told me, both verbally and in writing via email, that it would be ready for move in. Instead, they gambled with the move in date hoping that they would receive the Certificate of Occupancy in time. As a result, I lost money on movers, a storage unit, and other moving costs as I had to stay with a friend in ** until I could find a new place in Maine.Maine Properties is dishonest, unkind, and lack the skills necessary to run an efficient and effective business.       Maine Properties is the property ********** company supporting the lease up and ongoing ********** of ********** *****.  During the leasing process the developer provides anticipated dates the units will be ready to occupy that are relayed to the ****** by Maine Properties.  The rental requirements outline that a deposit is due within 48 hours of application, the deposit is an agreement to lease and not a security deposit. 

      In this instance the unit/building missing the developers expected occupancy date was a direct result of failure to receive a certificate of occupancy from the **************** for items related to site preparedness requirements.  Maine Properties did not in any way delay occupancy.

        An opportunity for other housing options was presented to the applicant, as with all applicants,but this offer was not exercised at that time in hopes that the next projected occupancy date set forth by the ********** ***** owner was within the agreeable timeframe of the applicant. Any holding deposit was returned to the applicant when it was determined they would not be moving into ********** *****.  

      Maine Properties is a third-party ********** company and cannot offer discounts on units without receiving approval from the owner.  While we recognize that communication may have not been viewed as timely by the applicant, we were communicating information as we had it available.
