    On November 4, 2023, Bin There Dump That was contracted by ************************* of ********* to deliver a dumpster to my residence of ******************************. They were given specific instruction via phone message, that I witnessed, to contact me upon arrival for proper placement of the dumpster. I took the day off to be here. They arrived and without instruction to placement, drove across my lawn where my sewer/water lines were to place it on my lawn, without even knowing where it should be placed. Their 3+ ton truck left 3" marks across my lawn and damaged my water/sewer lines. There first bullet point on their website is stating they place the dumpster upon instruction to placement from the homeowner. ******************* excavating came out and scoped my lines and verified that it had been damaged, with supporting photos. He had just replaced the new lines not long before. ******* of Bin There Dump That requested supporting evidence and quote of replacement to the damages as well as stating they would fix the lawn damage upon pick up of the dumpster. They now refuse responsibility of the damages to the lawn and lines.

    We are aware of the situation. ************** is not our customer.
    Our customer is **** Brothers.
    All our communication is/was from **** Brothers employee.
    Special, specific instructions that ************** provided to **** Brothers was not communicated to us. We have asked **** Brothers to get their insurance carrier involved. We have contacted our insurance carrier already. We are waiting for **** Brothers to move this ball forward. Regarding lawn damage; we assume this will be addressed after repair work is performed and assume it is part of contractors scope of work.

    In respects to ********** there has been communications as to non-negligence on their part; refer to above snap shot texts. Their lawyer, my lawyer, their insurance company, as well as mine, have all affirmed that Bin There Dump That, is fully liable for damages. It is absurd to think, let alone actually done, to drive upon any private lawn without first seeking out by the home owner where any underlying pipes may be, to avoid such casualties. **** clearly communicated that I would be home and provided my number for you to contact me upon your arrival. My wish is for you to assume full financial property damages without Court involvement.

    ****************** version of the events are inaccurate. Furthermore, I am disappointed that ************** never made an attempt to contact us directly once she determined there was damage to her pipes; otherwise, we would have forwarded all data to our insurance carrier and we would be on our way to a resolution. This will be handled as an insurance claim.

    Better Business Bureau:I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ********. Please add your rejection comments below; if you do not provide any details, your complaint will be closed as Answered. 
    My accounting of the event in question is most assuredly accurate. I did contact Bin There Dump That IMMEDIATELY upon the incident. ******* and I conversed via telephone, explaining the events of the dumpster driver not contacting me upon arrival for proper placement. He, at his own will, drove across my lawn without communication to me and 'assumed' his delivery placement without placement instruction. I informed her that he had driven across my lawn where my water/sewer pipes were and that I would be needing to contact my excavating company, ******************* Excavating, to come scope the lines for potential damages. She discouraged me from that, requesting that I refrain from that, ''there were most likely no damages" and "we are sure we can find resolve", further stating that "upon pick-up of the dumpster, they would repair the lawn damages that the vehicle left of 3" drive over ruts". 

    Upon further attempted communication with her, she made it VERY CLEAR that I was not to contact them directly, but to communicate solely through ************************* of Mold Bros. 

    I have provided all requested documentation of damages, recent new lines excavated and estimate of repair. 

    Indeed it is a matter of insurance coverage, as last statement from Bin There Dump That representative, of which Bin There Dump That is completely liable for. I HAVE BEEN attempting respectful resolution immediately following the incident, as has *************************. It has and continues to be met with resistance from Bin There Dump That.

    I continue to request that Bin There Dump That assume full financial responsibility according to forwarded repair estimate provided from ******************* Excavating.

    If, in the event that resistance to assuming full responsibility to damages, I will be forced to make a report to the Attorney's General Office.

    If you do not find attached communications supporting my claim, they have been emailed to *******, whom provide her email at the BBB to forward them. There should be 4 attachments.
