My husband and I signed a contract with *** ****** of Asphalt Expert on August 4th to have our driveway removed, and then replaced and widened where possible. The contract read "$25,000 to $28,000 depending on how bad under layer is". This contract was $5,000 to $8,000 higher than two other estimates we received, but ***** contract was more detailed about what he would do, did not have an "out clause", and he was third generation in the business. We trusted him and signed the contract. Then the problems started: First he did not communicate after we signed until an hour before he showed up the first time to remove the driveway and then when he came to lay the asphalt he did not call us at all: he just showed up, causing us to scramble both times to make sure we had our cars out of the way. (We do not know what he would have done if we were not home.) Then, when he was here the first time he started talking about charging us more to widen the driveway (which we are not sure he did), even though widening was in the contract. Then, when he was here the second time, he let us know that we should get loam, which he would provide, to prevent damage to the edges of the driveway that were above our lawn. We asked for a price quote on the loam, but he never got one to us. Then, on the day after the work was finished he showed up wanting payment. My husband was home. *** did not have a bill with him, saying he had emailed it to us. We never received this bill and requested that he resend it. (He never did.) My husband paid *** a total of $34, 500, $6,500 higher than the highest estimate! Fishily, *** requested that we make out one check for $9,000 in his name "to cover the cost of the asphalt". The remainder was in a second check for $25,000 made out to Asphalt Expert that was dated two days after the first check as we did not have the additional money in our account. We wrote him saying that we felt he had taken advantage of us: no response.

    Better Business Bureau:

I have reviewed the response submitted by the business and have decided to accept it, although it was less than satisfactory.   The business has agreed to refund us $2,000, claiming that the loam he laid next to the driveway cost $4500.   We have not received this refund as yet.  This offer came in response to complaint #********. I understand that by choosing to accept the business response that my complaint will be closed as resolved.

Please feel free to put out to the public any or all of our complaint, for either *** ****** is unaware of good business practices or he purposefully misled us.

    Regards,

    **** ********

We are pleased with the work done but the project came in $13,875 above the quote. Some of the extra was explained but *** demanded a check right away. He took my e-mail and promised an invoice and has never sent one. My wife and I have contacted him 7 times in 6 months since then to get an invoice and he either pretends he doesn't know who we are or ignores us completely. These were through both texts and their website. All we want is to see why we were charged that much and that we need that invoice for tax purposes, which we also explained.

I have already talked to ***** and sent the invoice he was looking for and at the time of the job i explained the extras  but I understand that it is a lot to take in during the process the extra cost was for having to dig the top section and horseshoe part of driveway, digging it down removing more than we discussed of unstable material, upgrading from gravel to recycled asphalt and then have to do two layers of asphalt on the horseshoe part than adding soil to all the edges that was never included

Estimate made 3-31-2023 and we discussed my well in the driveway and 2 metal barriers around 2 basement windows before the estimate was tendered.I was called 11-01-2023 he could do it the next day.I already had no returned calls and 3 no shows. He did show but now the well cover ( a 2in. cast riser ) and the 2 metal barriers were not included in estimate. At the end of the day those pieces cost an additional ***** dollars. There was also an area of lawn torn up and asphalt by my back door was too high and water goes under the door and into the cellar. He called the day he finished and said he would come back that day and fix problems at no charge. Have not seen or heard from him since.
