I signed a contract and paid a deposit of $2887.90 with ***********************************, owner of Able Two carpentry and home remodeling on June 30, 2023, to remove an old pavilion structure and build a new one. The contract stated work would start July 17th. The Saturday before the start date I was able to get a hold of him and he stated that he would be there Monday and to expect a delivery of materials. Monday came and went with no delivery and no one showing up for the project. On Friday, July 21st I received a letter from his insurance company stating his insurance had lapsed as of July 15th. I tried calling, texting, and emailing him throughout the week and didn't get a response until late Friday evening. He stated he was going to take care of the insurance first thing on Saturday or Monday morning depending on when they were open. At this point, I asked for my money back, but he stated he already purchased materials with it at Ware ****** and I asked him if I called Ware ****** if they could confirm this. He said they could. He also stated he would be here Monday to start the project and the materials would be delivered on Monday also. I stayed home from work in anticipation of this. Monday came and ******* did not come to start the project nor did the materials show up. I called Ware ****** and they confirmed that there is no account under *********************************** or his company Able Two Carpentry and home remodeling. I also called his insurance company, and they had no record of him calling or coming in to resolve the insurance issue. I have called and texted since then and have received no response. I am looking for my deposit back since the project has not yet started and insurance has not been maintained as stated in the contract.
