    The Association contracted with Mr. ***** to perform an exterior painting project in July of this year. Once we received his initial set up paperwork (W9, insurance, invoices), he was issued a 1/3 deposit to start the work. The remaining payment would be made upon completion of the work. He completed the 1st of the 2 buildings to be done fairly quickly. Unfortunately, he never did the work on the 2nd building. He was followed up on multiple times and we continually were given dates that he would be out for but then never showed up. On October 25th we gave him a deadline for the work to be completed by or we would want the deposit for the last building back. The deadline was due to the weather dropping below freezing temperatures. He stated that he would be out to complete the work before the freezing temperatures but didn't show up again. He tried to get the Association to allow him to perform the work in the lower temperatures. When the Association held their ground on the deadline, he agreed to return the paint that he purchased with the deposit and the remaining balance of the deposit on November 10th. It is now December 27th and he has not returned the paint or deposit.

    I am rejecting this response because: The owner Dave ***** called me on January 11th stating that he was out of the state currently. That he will be back in town the 1st or 2nd week of February. At that time he will contact me to return the deposit and the paint that he purchased with it. Unfortunately, he has stated multiple times in the past that he would do something and then never followed through with it. Until the money has been returned along with the paint purchased with it, the matter is not resolved.
