H&H towed my car within retail parking, claiming due to my sticker indicating I was a tenant of nearby apartments that I was illegally parking. Given my receipt, eyewitness accounts, and support from *************** of my customer status, H&H refused to release my car from impound. Among other things, the cashier ******* Que was extremely rude and when asked how to resolve the situation,n continuously encouraged giving up to pay the $382 fee charged to me. I ask that the BBB contact H&H to refund if necessary the $382 + additional fees that they are likely to charge in the event I am unable to get my car released. I have been economically hurt by this situation, not only monetarily but in terms of time spent to rectify the issue which was inflamed further by the owner, manager, and sole employee at H&H illegally towing my car despite my proof of retail business.

    Business Response

    Date: 12/12/2024

The complaint has insufficient information for us to respond adequately to this claim. We will need the invoice number of this transaction. However, when H&H Mobil tows a vehicle from private property, we do this following the property owners policies. The complainant may want to reach out to the property owner for resolution. Responding to the complaint of poor customer **********************, ********* has worked for H&H Mobil for many years and has never been known to treat anyone poorly and we have never received complaint in many years.

    Customer Answer

[A default letter is provided here which indicates your rejection of the business's response.

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of why I am rejecting this response appear below:

H&H Mobil's response is inadequate for a variety of reasons due to lack of confidentiality that will likely result in retaliation.  Regardless H&H is not abiding by Michigan Code Laws for towing which involve calling owner, but more importantly admitted when asked that they have monitored the lot where tow occurred and were actively waiting to tow.  In addition to code violation, H&H fails to reach requirement to tow due to the car in question being used for commerce as sign stipulated.

Response from H&H flags that complainant should talk to "RiverCaddis" as if H&H is not the ultimate enforcer and enjoys full responsibility for seizure of vehicle.  As for secondary response regarding customer ********************** ******** on many ****** reviews has been highlighted as a problematic cashier, business owner "**** *******" seeks to dismiss claims. invalidate, and lie on multiple occasions about the content of conversation involving tow.

I urge the BBB to proceed with judgement or H&H refund costs for "unreasonable tow" per MCL - Section 257.252a.  Given that H&H fails to abide by these rules and shows unsatisfactory resolve to the situation I respectfully reject this business's response.

    Regards,

    ****** ****
