***** DuBois was engaged to provide excavation services, septic tank/drain field installation, and final grading for a new construction.
I believe Mr. DuBois does the bare minimum and cuts corners. The dirt road that he was engaged to install was filled with potholes. Areas around the home had standing water for weeks after any rain. When he sent his final bill in March 2023, I kept $5,000 back and told him I’d be happy to pay the rest once he completed the services agreed upon in the contract. Mr. DuBois stated that he had reached the legal point of substantial completion and he did not intend to return.
Shortly thereafter, Mr. DuBois sent me an invoice for a late fee and invoices for additional services totaling $13,102. Unhappy that I asked him to satisfactorily complete the work, Mr. DuBois created invoices for alleged work going back to the beginning of construction 18-months prior. These extra billings were not discussed or priced out at any point during construction, nor were they approved by verbal agreement or a written change order. I discussed these charges at length with my general contractor who had significant concerns about their legitimacy. Given the scope of the work, my general contractor estimated that the billings for labor hours were approximately three to four times what they should have been.
I called Mr. DuBois and stated that these invoices were excessive and unapproved. Mr. DuBois immediately became hostile and threatening. He told me this was a small town and he is great friends with the local circuit court judge. He told me his lawyer was ready to sue me in her court. He then went on to state that he would call my employer and reference my character if I didn’t pay him.
I felt that continuing to deal with Mr. DuBois whether to satisfactorily complete the original work or in court regarding these additional billings was a waste of my time and personal peace. I find him to be dishonest and of poor character.
