I won a car in an auction at Biddergy, the description of the vehicle says it runs and drives, and when I went to go get it. It does not start or drive, i tried charging the battery and it won't hold a charge. I am wanting a refund for it because it is false advertisement.Business Response

Buyer won (2) vehicles from our online auction on 6/4/2025. Buyer has yet to pay for the other vehicle in the amount of $1,673.11. Buyer emailed us and said he only wants one vehicle and cannot afford the other vehicle. Buyer agreed to our terms and conditions in our entirety on 5/9/25 which state in multiple areas that all sales are final, all items and sold as is, where as, all bids are legally binding contracts, etc. We suggest the buyer reviews our terms and conditions in which he agreed to at ******************************************************************************. Buyer's account has been sent to legal for collection.
Regarding the Prius and its listing, upon picking up, our lot manager assisted the buyer in starting the vehicle, it is a hybrid, and it appeared the buyer didn't know how to operate the vehicle. Running and driving condition was verified along with video evidence of the condition. The vehicle in question is a 2008 ****** Prius with ******* miles, winning bid was $1,275.
In summary, vehicle was sold as described. The bigger unresolved issue that may result in litigation is the buyer is currently in default of a contract in the amount of $1,673.11. We urge the buyer to resolve this issue.

I am rejecting this response because: no one ever reached out to me after my last attempt to reach them, as I stated in my original complaint. As it also shows in the pictures I provided in my original complaint, the item was listed as in new, working condition. If Biddergy would refund my payment in full, I would be happy to return the item to them and close my complaint.

When I called on 11/9/2024 at 10:50am, my call was not answered and sent through to a phone tree with no ability to leave a message. This company has sold an item they listed as in new, original box, in new condition that does not work. Our terms and conditions do state All items listed for auction are to be sold "as is, where as". All items are sold without warranty of any kind, neither expressed nor implied, all sales are final. The customer is correct that the item in question was listed as NEW in ORIGINAL PACKAGING. After further review, the item was tested prior to auction and was in working order. After the first discussion it appeared that this was an operator error and a manager attempted to instruct the customer on how to operate the unit. A representative did reach out and did not hear back so it was assumed the customer read the operating instructions. While not required to do so, if the unit was truly defective we would and still would honor a refund or exchange.Business Response

*************************bit talk about a heart. I am glad shes not in the medical professional, but she sure shouldnt be dealing with people at all. There is a remedy to all things and its not to say go ahead and drive that unsafe bike with your terminal illness with the brakes that dont work in the grinding with no insurance all the way home. I doubt it worst experience ever and I just want everyone to know what I went through and to be warned this place should be watched. Maybe somebody should try and bid and go in there and when they send you a paper that says you cannot drive off on it without insurance and things of that nature watch how easy it is to do especially after they are extremely rude and refused to budge on giving you your money back and charging you a fee after you explain the bike was grossly missed described and unsafe to drive. I dont have any pictures of the motorcycle on at this moment, but I can take them if needed and send them over.Business Response

This matter has been resolved however here are the details of the situation.
The motorcycle was listed as runs and drives, new battery and tires. A photo also was attached to listing showing the error message. As with all our items, all items are available for inspection prior to auction as all items are sold "as-is, where-as" with no warranties.
Upon arriving to pay and pick up the item, the buyer stated he was not driving the item home and declined a license plate therefore insurance was not required. A staff member witnessed the buyer attempting to get on the item and it was clearly to big for him and he was attempting to find any reason to get out of purchasing the item. As a resolution, staff offered to relist the item for him with no fees in the next scheduled auction, that was not desired and the buyer left the facility apparently riding the item after telling us that he was not going to be.
It is important to note that this is the 3rd incident with this buyer. The buyer has created multiple accounts, purchased multiple items and not paid for them, and has backed out of multiple purchases.
It is our mission to provide the most accurate descriptions and photos to our potential buyers. In addition to this, we've invested millions of dollars in our facilities to offer a convenient place for potential buyers to inspect items for themselves. While items are sold "as-is, where-as" as with any auction, we always work with our buyers when unforeseen issue occurs.

I have reviewed the response made by the business in reference to complaint ID ********, The businesses response is factually inaccurate. They made a second payment to me for the disputed amount, so the case is closed. Except the BBB is lending an "A" rating this business and they are shady af. They paid me the disputed amount only because I was very persistent, I still had to get the BBB involved. They passed me from employee-to-employee wasting my time and now yours. I'm sure I'm not the only one who had bad experiences with these very dishonest people. They rating you give them should reflect their business practices and the experiences of their customers.

This situation has been resolved however more details should be noted. The first auction was successful and the seller was paid for the high bid amount per contract. The unit was then relisted under the new seller at their direction and it went for more money than the first time.
