They took over trash collection from ****** disposal and serviced me until I canceled. Now they bill me ******* dollars for canceling early. I never signed any contract. They bullied me and were rude on phone. They are threatening my outstanding credit. They need to zero out this stupid bill.

Mr.****s complaint stems from being charged for the remaining term of service on his customer agreement and a container removal fee of $100 when closing his account with us.

The container removal fee we charged Mr. **** is not unusual for our industry, nor is it particularly high. However, we have determined that it was not spelled out well enough in our customer communications, so we have credited Mr. ****s account for this charge. We apologize for not appropriately communicating the existence of this charge.

The contract term is referenced in our Terms and Conditions in the Term section as follows: This Agreement shall remain in effect during the term specified in the Service Agreement, and if no term is specified, until the end of the current calendar year (the Term). The Term shall automatically renew for additional Terms of 12 months each unless either Party gives written notice of termination at least 90 days, but not more than 180 days, before the Term expires.

Paying for the reminder of the contract is specified in our Terms and Conditions in the Termination section as follows: If you terminate this Agreement prior to the expiration of any Term for any reason other than Grangers default, or if Granger terminates this Agreement under this paragraph, you agree to pay the most recent monthly charges multiplied by the number of months remaining in the Term. You will remain responsible for all amounts due for Services performed prior to the date of termination.

When ************ came to us from Alchins Disposal, he received a letter referencing the web page www.grangerwasteservices.com/alchins as a location to find information about his new service. Featured prominently at the top of this page is a link to Grangers Terms and Conditions. Additionally, the first invoice Mr. **** received from us after beginning service contained the following statement: Receiving Granger services indicates agreement with our terms and conditions.Review terms and conditions at www.grangerwasteservices.com/terms.

While we understand why ************ is unhappy about being charged for the remainder of his agreement with us, we feel we are justified in these charges for the cancellation of services, and that they are appropriately referenced in our customer communications.
