I am writing to formally file a complaint against MEMBERS FIRST CREDIT UNION, which has wrongfully blocked access to my account, unlawfully freezing $360,000. in funds that were credited to my account after the bank processed my promissory note from me. The promissory note, which I provided for a loan of $35,000. was processed by the bank through it's clearinghouse system, ultimately resulting in $360,000. being credited to an account credited in my name. Despite the fact that I am the holder in due course and the rightful owner of the account, the bank has frozen the account and denied me access to my funds. The bank has not provided any legal justification or due process in freezing the account, which is a direct violation of my Constitutional rights to property under the Fifth Amendment. Deprivation of property: The bank's actions violate due process, as established in ******* *.******, 407 U.S 67(1972),where the Supreme Court held that individuals cannot be deprived of their property without due process. The blocking of my access to the account without notice or hearing violates these principles. Bank's Role as Custodian or Trustee: The bank has acted as a Custodian or Trustee of my funds and, under fiduciary principles outlined in ************* v *************************,***********(1979), it must uphold its duties to act in good faith and protect my property rights. By withholding my funds without justification, the bank has breached its fiduciary duties. I do not owe this debt, I am not sure where this charge is stemming from. I am filing a complaint on this company pertaining to the information on my credit status is showing charged off but is reporting negatively on my credit report, It has been charged off for several year and reporting me in a bad light.Business Response

Members First Credit Union is currently reporting information to the credit bureau regarding a charged off unsecured loan and a charged off negative balance on a checking account. These funds have been charged off by the Credit Union; however, this does not release the member from their obligations under the Membership Agreement or Promissory Note, and these amounts are still owed to the Credit Union. I was trying to dispute charges that the bank allowed because someone stole my card and wallet,I filed the paperwork on 6/24/24 but because the printer or some error didnt allow them to transfer all the transactions that occurred in ******* they hand wrote it and missed some and I didnt notice it so they thought I made the transactions and couldnt do anything about it in other words. They claim I didnt call again but i did on 6/29/24 and I asked did they need anymore information from me,the lady told me because I went in person they didnt,I also told her going forward please send me stuff via email because I dont take spam calls and sometimes my phone doesnt receive calls either. So the lady called on 7/11/24 I was on vacation that week so I couldnt reach her and because she couldnt get in contact with me they said theres nothing they can do and Im sorry but this the 4th time my accounts been compromised and they really need to update there security and check for this because of all this they told me they cant do anything and that Im out that money that someone else did basically,they wont reinvestigate my case because of the two missing transactions. I would like an apology and my money returned. I had to get a new card because of this issue and its not my fault someone on the internet decided to do spending spree in ******* on my dime. So the Grubhub and Michigan adventure were me but I lost my card after that and I dont know how the other Michigan adventures charge happened I feel like that was a separate claim but still fraud. Its okay for them not to call me but Im just getting the around from them and Im sick of it and I did get loud but there response was just bs and they didnt help me so whatever. Im including the call log too to show I actually did contact someone. I also would like better monitoring to occur cuz this is ridiculous.Initial Complaint

Thursday the 10th of November 2022, I went to deposit a check dated for the 11th of November. I did this because one of my coworkers did at another location. The teller at ********* location told me (amongst having a very snide tone) they were not willing to make the deposit solely based on the date on the check. I didn't need access to those funds until the posted date on the check anyhow. However, being that my coworker was able to I seen no reason why I was not able to, we own portions of this credit union (the purpose of going to a credit union and not a bank). They even said the Senior manager on shift was not willing to do anything about it. I'm unsure of why they discriminated against me as I've been using this financial institution for years now. I'll never go back to ********* location unless it is absolutely necessary. Oddly enough as soon as I left after this interaction, my debit card was locked (in a local zip code).
