Grace Construction created a large amount of damage to the lawn in the backyard of our house in the process of performing storm damage to our house. It all stem from using a piece of heavy equipment that was designed to be used on paved ground traveling across our lawn. At first they maintained the damage was done by a different contractor but later agreed with me that they were at fault. Since that time it has been one delay after another, promises made that they would be out in a day or two but never kept. Now they do not even answer my telephone calls. This condition is making it very difficult to keep the lawn properly cut and is likely damaging my lawn tractor in the process.

We let him know we don't cover any ruts per the contract. Nothing in the contract states ruts would be cleaned up. The tree company was there before we were and they left ruts as well and a pile of wood chips.

    Complaint: ********

I am rejecting this response because: The tree company they mention did not create nor leave behind any ruts in my lawn. The ruts in my lawn is damage that was done solely by Grace Construction. Regardless of the absence of any mention them in the contract only reinforces the fact that it was damage caused by them and solely their responsibility to repair.

    Sincerely,

On 2/14/22 I came home to a leak in the bathroom behind the shower wall, I shut off the water and called "Grace construction LLC" I spoke with **** *****. He came over on February 16th 2022, he went into the bathroom and took a hammer to the tile above the faucet and stated "It was a bad diverter valve' from there we made an insurance claim. The very first check we received on March 4th 2022 was 8,***.66$ this was to remove our personal contents and belongings from the basement to storage. We removed the items ourselves and stored them and **** was given 1,*00$ out of that check.
On April 7th 2022 My family and I moved to the Stay Bridge hotel in Southgate, **** then proceeded to demo the bathroom and had all title removed from the basement floor due to water damage. On May 13th 2022 Grace Construction received a check for $11,677.67.
    May 16th 2022 **** ***** himself received another check for $3,391.00.
After receiving these checks nothing has been done in the bathroom besides the demo. **** reached out to me on May 23rd 2022 stating "He could not put the bathroom back together until the insurance company payed for everything because he was going through a divorce and the company accounts were frozen, he had no access to any money to get the bathroom and basement put back together'. Therefore the job went unfinished he asked "If I could finish the job myself and he would work things out with the insurance company since I gave him the $1,*00". At that time I went to home depot and purchased everything that was needed to get my home put back together out of my own pocket. June 22nd 2022 I received a check for $19,019.4*.
    Tuesday July 12th 2022 I received a check for $1*,1*8.80. August 11th 2022 I received a check for $*,374.93.
Within the week of receiving the last check **** called me threating to put a lean on my home accusing me of owing him $10,194.93.

did state that he received a check for $*,374.93 and he kept that check.

On August 17th 2022 **** showed up at my home with a police officer which a police report was made. My mother paid him off in full $4,800 cash.

Nothing beyond the demo work has been done.

    Hello,

This is in response to a letter dated 8/24/22 re: a customer complaint. Please see our response and attachments below.

This complaint was placed by **** *******. **** ******* is not the owner of this property or the policy holder of the insurance that paid this claim. Apparently he is the nephew of the homeowner and was fraudulently identifying himself to our company and the insurance company as **** *******, the owner of the property. The owner of the property is **** ******* (see attachment from insurance company with owner's information as well as the work authorization signed by Mr. *******). This project was an insurance claim due to water damage. We began to work with Mr. *******'s insurance company in February 2022. We received a work authorization signed by Mr. ******* to mitigate the water damage, do the demolition of the areas affected, and to put back new materials in the areas that were affected by the water. Upon inspection there was concern for asbestos and lead in these areas. We contracted with another company who is certified to do lead and asbestos testing and removal. There was asbestos found and the company was then paid to perform the removal of the asbestos. Once the conditions were safe from asbestos, our company then proceeded with the remainder of the demolition work and the dry out. In addition to the asbestos and lead mitigation, demolition and dry out work that was done at the property we spent 100 man hours with emails, phone calls and site visits to ensure that this customer was properly compensated for the work that needed to be done by his insurance company. After we performed the work that was done for the mitigation and demolition, **** ******* informed us that he had been signing and cashing the checks from the insurance company that were coming in his uncle's name and that he wasn't going to give our company any more money to put the property back together. He stated that it was because we were "paid too much money". Our estimate for the entire project was for $*6,8*6.98 including the asbestos testing and removal. **** refused to allow Grace Construction Group to return to the property to complete the work that we were contracted to do and stated that he was going to take the rest of the money and do the work himself because he wanted to keep the rest of the money from the insurance company. We received most of the payment for the work that was completed by us with the exception of $4,800. After multiple phone conversations, **** agreed to allow us to come and pick up the final amount owed to us. Unfortunately we had to get the police involved to ensure that there wasn't any issue during the pick up of the final payment.

    Thank you,
    **** *****
