The situation described involved a recent property sale where the seller had a newly established mortgage. Due to the newness of the mortgage, the payoff amount was not immediately available at the time of closing. The parties chose to close without a payoff amount, therefore, an amount larger than the sellers mortgage was held in escrow.When the payoff amount was received from the seller's lender, it exceeded the amount held in escrow. The escrow agreement, signed by seller at closing, clearly stated that the seller would be responsible for any shortfall in the escrow held. This is a standard practice to ensure that all parties are aware of their financial obligations and to facilitate a smooth transaction process.Regarding your mention of our corporate counsel, we want to clarify that their involvement is to ensure that all transactions comply with legal and regulatory standards, protecting the interests of all parties involved.
