    Original contract signed 8/5/24 with down payment $17520. Second payment of $8760. Third payment of $8760 ($1837.65 paid directly to homedepot for windows); $3137.30 final payment. Contractor ***** ***** is in violation of original contract on multiple accounts. He agreed to complete the project within 8 weeks, and it is now 5 months later from date of signed contract and the project is not even 25% complete.1)Warranty. The Contractor warrants that, following completion, the Work will be free from material defects. If, within one year of the date of completion, any aspect of the Work is found to fail to meet the expectations set out in this document, the Contractor shall promptly correct the defect after receiving notice from the Client, unless the Client has previously accepted the defect in writing. However, contractor received noticed 12/16/24 that the roof he installed was leaking and he has failed to remedy the leak. He was notified that the siding was not installed properly and he has failed to correct the installation.2)The Contractor did not comply with the original terms of the Agreement which specified that the Contractor would not abandon the Work for more than 10 days within a 30 day period and therefore is in breach of the Agreement.Client is asking for termination of agreement signed with no additional money exchanged.
