      I signed a lease at this apartment. I stated to the manager that I might need to pack up and move due to my safety. My ex husband has been stalking, harassing and scaring my son and I. The manager there **** stated to me and in front of a witness that if I needed to move that I can leave without paying break of lease fees. Feb 2024 I needed to move and it's been a ongoing struggle with the managing keeps stating now that I need to pay $1900 for lease break and 2 months of rent after. I cannot afford any of that even after her telling me I didn't have to.

      Thank you for the opportunity to reply. We do abide by the state of Minnesotas Right of Victims of Violence to Terminate Lease. The conditions per Minnesota statute for release include:
      The tenant must provide advance written notice to the landlord stating that:
      1. The tenant fears imminent violence from a person named in an order for protection or no contact order, or a writing produced and signed by a court official or city, county, state, or tribal law enforcement; [Minn. Stat. 504B.206, subd. 1(b)(1) (2023).] and
      2. The tenant needs to terminate the tenancy; [Minn. Stat. 504B.206, subd.1(b)(2) (2023).] and
      3. The specific date the tenancy will terminate. [Minn. Stat. 504B.206, subd.1(b)(3) (2023).]
      The law requires that the advance written notice must be delivered before the termination of the tenancy by mail, fax, or in person, and must include the order for protection, no contact order, or qualified statement.
      Additionally, the tenant is responsible for the rent payment for the full month in which the tenancy terminates and forfeits all claim for return of the security deposit. [Minn. Stat. 504B.206, subd. 3(a) (2023).] In the event that the tenant owes the landlord rent or other amounts for a period before the termination of the lease, the tenant will continue to owe that amount to the landlord. [Minn. Stat. 504B.206, subd. 3(c) (2023).]
      The tenant has recently notified us that she has vacated the apartment and left the keys in the apartment home. Because the requirements for the Right of Victims of Violence to Terminate Lease were not met, the move-out is considered an Improper Notice and the tenant will be charged accordingly. If the tenant provides documentation from Item 1 listed above, we are agreeable to modifying the move-out charges as appropriate.
      We do request that the resident provides us with her forwarding address.

      I moved out of an apartment and they charged me $350 and they did not clean the apartment. The apartment was in very bad shape old appliances stove was 50 years old carpet was 40 years old they replaced it. my window was broken open The windows are extremely old and they're all falling apart.and they replaced the windows that they charge me to clean the windows, and they didn't clean any of it it was not because of me that these things had to be replaced. Yet they charged me to clean it. This is definitely a scam they're taking money from people that they did not earn to take.

      Resident provided a two-month's written notice on 11/30/22 of intent to vacate. Later, the resident extended her move-out date until 3/31/23. Upon receiving the resident's written notice of intention to vacate the apartment, we provided her with several documents:

      -Right to Enter, explaining that we may be showing the apartment in an attempt to re-rent

      -Management's Acceptance of Move-Out Notice, which included instructions about the move-out process

      -Standard Cleaning Instructions and Cleaning/Repair Charges. This document included instructions for cleaning and an itemized list of standard charges for any cleaning or repairs needed. The standard cleaning charge for a studio or 1BR apartment is $350. 

      Upon inspection of apartment at move-out, the Regional Manager observed that the apartment had not been cleaned. The resident was assessed the standard cleaning charge in addition to a remaining rent balance due from March and a holdover rent charge for ***** as the apartment was not vacated until 4/5/2023. Photos were taken of the unit to document the condition.

      We did not assess charges for the heavy smoke damage to the walls, the damaged carpet, or the broken blinds.

      We strive to remain consistent and fair with move-out charges at all our properties. We accepted the resident's notice to vacate in writing, provided her with information and instructions on the move-out process, included a standard list of cleaning and repair charges, and took photos to document in the event of any questions. We are confident the standard cleaning charge was fair and appropriate.

       I am rejecting this response because:

      They have yet to provide me with an itemized list of what they cleaned. I need the itemized list I think that is only fair. Otherwise they are overcharging people for something that they did not do.

      Itemized details are provided when per-item cleaning charges are assessed. In this case, cleaning was not completed throughout the apartment, and the flat-rate cleaning charge (noted on the Move-Out Instructions provided to resident) was assessed.
