      I use this builder in building a home for me. There was constant delays within the building process, so when it came down to closing, I was already frustrated at the owner and their general contractor. We had closed just barely but we had an escrow that rolled over with a deadline of July 31, 2022 to finish exterior projects on the house to include grading. Unfortunately, they did not meet that deadline in finishing the grading of the house, so I went to my landscaper that I was already going to use for rock and sod. I had tried to get reimbursed for getting this done since they did not hold their end of the Escrow timeline. I even had noticed on there that if I did the work, I would be refunded the money.

      The home was for this buyer was built in 7 months from commencement of construction to completion.  The average new construction timeline for residential homes during this time period was 9-11 months.  As the general contractor we were able to secure the lot on behalf of the buyer after the buyer failed to secure the lot himself through his original VA loan officers attempts.  This homeowner has been ignorant about the state of the economy with labor and material shortages throughout the entire building process even though we were able to complete his home through winter construction 2-4 months sooner than the national average even with the homeowner completing work on the home himself, which he still had not finished at closing.  He is still is ignorant to these facts.  Quite frankly, we should have cancelled on this buyer during the construction process as he belittled and harassed several of our subcontractors (which we had to convince not to walk off the job) on the job site, along with our job superintendent, closing company, my partner and myself.  The only reason we did not cancel was due to the fact that he is a veteran and we respect the fact that he served our country.  The escrow agreement that was agreed to and signed at closing stated any work to be completed on or before July 31st.  We did not hit that date however, our final grade (which was on the escrow agreement) was the last remaining item and was scheduled to be completed on August 1st.  The buyer refused to let us complete the grading 1 day after the agreed upon date so we agreed to release the funds held in escrow to him once the local authorities inspected and approved the final grading per their requirements.  As of today and as I am aware, this still has not been completed so no funds have been released to the homeowner.

      The buyer has nothing to file a lawsuit against our building company.  The issues he has referred to have been resolved as much as possible on the side of the building company.  The buyer chose to finalize the work we had in escrow and will be refunded the monies once the governing municipality signs off on his work.

       I am rejecting this response because:
      He has made not attempt to resolve this issue at all with me. This is the only communication that I have got from him since late July. Since I made the work on the Escrow and the builder could not fulfill the original timeline, I entitled to the money from the Escrow plus refunded the extra charges I put into since the builder did not accurately put in the correct amount. I would like the Professional cleaning refunded to me as well since there was $400 worth of my personal labor put into cleaning the house since it was not done like I had mentioned in the original complaint.
