    I have a contract with NewLines Remodeling. They have been paid ******** so far.Their approx. start date was to be Sept 15. ******************** Movers are to shore up the house while a sub contractor is suppose to escavate and lay footings for the foundation. The General Contractor and sub are not in agreement regarding them selves, and their contract. I am caught in the middle and no work is being performed. The subcontractor has disappeared with *****. that was his 1st third. The General Contactor keeps making excuses as to why work is not performed. The sub cement contractor called me yesterday and went on and on about their agreement and contact.We are fast approaching winter. My home cannot be lived in, it is vulnerable to vandals, and someone even messing with the under-pins. Critters can get in and do damage to the house as well. They were to have the completed by Dec.30. Given the cure times of cement footings, if ever poured, they will not meet that timeline.

    We have had an issue with a concrete sub that walked off the job. I have been in constant communication daily and even multiple times per day with ***** and a lot of this communication has been done over the weekends and late nights.

    I have been completely transparent with the issue and worked as hard as I could to get a new concrete sub out there. We now have someone on site working and we are working as promptly to ensure we mitigate as much of the lost schedule as possible. 

    Also as the ** is also my job to manage my subs and so far everyone including myself have noticed ****** ability to tell us what to do like she can control our schedules or how we do our jobs when we are the professionals. And its been difficult as one of the subs refuses to speak with ***** because he almost feels harassed. And this sub has done what hes said and has not held up the project timeline.

    Again I would like to point out that the sub walked off the job and Ive been working very hard to ensure we get the job done as quickly as possible and with great quality. And as mentioned before I have been very clear with ***** along the way and have never ignored her texts or call and has always told her the exact status I was in.

    I apologize for any and all inconveniences and we are suing and of course will never use the original concrete sub.

     I am rejecting this response because:

    I reject his response. 

    His 2nd concrete sub, who he states he vetted did not use cold weather standards regarding heat use of cement, cement bags, cement blocks. Upon pouring the footings, the 2nd subs put the footings in the wrong place. He was not there for any of this work. They continued to set block not meeting cold weather standards. The wall was so deficient, it was not level, plumb or square. This is what ******************** did. A structural engineer recommends all be torn out, stating " it is the worst job he has ever seen." The code violations are mentioned and they are horrific.  In the mean time my home sits being held up by underpinning, which is not stable!!!  This is going on 3 months now. As for the schedule, the ** has not provided me any schedules even though I have requested a schedule repeatedly.

     

    He wants to continuously blame everyone except for the guy in the mirror.  Who chooses the subs? Who did not provide proper oversite of either sub? If he had seen what was going on with his 1st sub, it was obvious that he was in over his head. I would call the ** begging him to come as I was very concerned.  ** stated " it is not my job to baby set."  I kid you not!

    As I have previously stated, I have been doing everything I can to ensure the completion of the job. I had also informed ***** that I couldn't be there when they started due to being out of town and I was unable to change the dates. 

    I have not been giving any excuses, I have always told ***** the truth and was very transparent about the project and where we were at with the status. Yes there have been issues and I have been very willing to work through them and honor my end of the contract. I had also been working with the city inspector to ensure we were on the same page and we had extensive discussions to ensure we were going to proceed accordingly. 

    This has been a difficult project to get through due to a couple big reasons. One of them is time because she wanted this done at the end of the year. This unfortunately caused a lot of issues because the first concrete contractor kept pushing dates out and out to the point where I couldn't wait and hope he would do the work. The second concrete sub I hired who ***** also vetted and was very pleased with started the work and got very little done and then left the project taking the deposit I gave him and never returned. 

    The current concrete guy I chose due to his ability to start asap and he was within budget and his prior work showed he could handle it and he owned his own equipment. ***** found a concrete contractor who was out of budget. ***** never provided me the quote as I asked many times so I could look over it as I am the ** on the job. The current concrete sub did have some issues and was willing to fix based on the combination of engineering reports. I have been doing everything I can to get the job done and as soon as we can but as we have hit some snags I have had to get engineering involved to provide solutions. One delay was due to the prior work done before us where they cut back the floor joints too far and we had to get a resolution.
