- If TMA E-Marketing is unable to fulfill its contractual obligations, due to circumstances beyond TMA E-Marketing's control, TMA E-Marketing will refund Client's investment for any hours/work paid for, but not performed. Circumstances beyond TMA E-Marketing's control include, but are not limited to, acts of terrorism, natural or manmade disasters, severe illness, acts of war, etc., when such circumstances substantially hinder TMA E-Marketing's ability to fulfill its obligations. Refunding Client's investment for any hours/project work paid for but not performed/completed will constitute TMA E-Marketing's sole and complete liability.
