BBB Complaint: Unauthorized Towing and Misrepresentation by Handyman Hardware Complaint Details:On October 31, 2024, I visited Handyman Hardware to replace the battery in my key fob. After the replacement, the fob malfunctioned, preventing me from starting my car. Due to this issue, I had to leave my vehicle in the Handyman Hardware lot temporarily, as I needed to retrieve my spare vehicle and take the fob to a dealership for reprogramming. I managed this situation while also attending to my young daughter at home. When I returned to Handyman Hardware, I spoke directly with the store manager, who explicitly gave me permission to leave my vehicle parked in their lot until I could return to pick it up. Despite this agreement, I discovered the next day that my car had been towed at my expense, resulting in a $207 fee. Furthermore, Handyman Hardware misrepresented the situation to the towing company, claiming my car had been parked in their lot for multiple days, an allegation that is completely false and contradicted by video evidence.I am filing this complaint with the Better Business Bureau to formally request that Handyman Hardware reimburse me for the $207 towing fee. I have comprehensive evidence to support my claim, including video footage, receipts, witness statements, and a record of my communication with the store manager confirming that I was granted permission to leave my vehicle temporarily. This action by Handyman Hardware was not only unwarranted but also demonstrated disregard for customer rights. Without resolution, I intend to pursue this matter through legal channels and will also notify local media to ensure public awareness of Handyman Hardwares negligence and misleading practices. I hope that Handyman Hardware will resolve this matter promptly to avoid unnecessary escalation.Resolution Sought:Reimbursement of the $207 towing fee.Sincerely,******** ***** *********

    Business Response

    Date: 11/12/2024

In response to this complaint. In the morning of day one: Mr. ******** had an issue with a key fob that stopped working. He left his vehicle parked in a manner that blocked our customer entrance and partially in a Handicap parking stall. He left his vehicle parked there and came back in a different vehicle again taking up two parking stalls, one of which was a handicapped stall. There was no Handicap permit on this vehicle. He did not have any conversation with the store manager or any other person in charge to let us know he wanted to leave his vehicle there.  Had he spoken to a manager we would have directed him to move his vehicle to the main parking lot, out of the Handicap parking stall and away from product displayed in front of the store.

Day two: We had several complaints from customers that our handicapped parking stall was blocked. The vehicle was unlawfully parked in a Handicap Stall, on private property overnight and blocking product displayed outside our business. After 24 hours of the vehicle being parked there, we had it towed. He has filed a legal action that we will defend. We strive to resolve this in a reasonable, fair manner.

    Customer Answer

I am rejecting this response because:

I am rejecting this response because I had explicit permission from management to park in the location where the vehicle was towed. The representation of the debt and the parking situation is misleading. Due to the recent snowstorm, the ground was covered, making it impossible to clearly determine specific parking boundaries. I followed the instructions given by management regarding where to park.

When the vehicle was towed, the towing company was misinformed and told it had been parked there for several days, which is untrue. I have evidence and a third-party witness statement confirming that management gave me permission to park in that spot. This response is unacceptable, and I will vigorously pursue this matter in court.
