      We contracted for broker services because we did not want people walking through my parents home. The contract was from 12/7/23 ending 12/30/23. *** ********, the owner, said they would be there and only let in 2 or 3 brokers at time. He put a lockbox on the front door with my front door key. *** ******** said they did not feel comfortable holding someone's key in their pocket. We were there once when 2 men came in and *** ******** was not with them. They left when they saw us. On 12/14/23 I sent a picture to *** ******** showing damage to the patio door. The aluminum track had been bent. *** responded in regard to a repair. On 12/22/23 when we went to the basement, a mess had been made. The sale ended 12/26/23. *** ******** left a check in the storm door in an unlocked location. I was only given $2,600 in proceed, which seems very low.

      I have contacted ***** **** * ****** which is where I purchased the patio door in 2013 for $1,650.  See attached pic.  And pic of email from ***** **** * ****** telling me it cannot be repaired only replaced.  I sent copies of same to *** ******** today,January 11, 2024 via email.  I am requesting payment in the amount of $1,650 which is the original coat of the patio door.  I also am still wanting a copy of his "after sale accounting" showing me how he came up with the $2,604 proceeds for the entire estate sale.  (See attached pic of contract and check).

      January 15,2024 more info:  *** ******** sent me an email saying he emailed me the info regarding how he came up with the proceed amount.  I email him back saying I never received it please resend, he never did.  I also told him about this BBB complaint.  And about ***** **** * ****** telling me the patio door track cannot be replaced, that track is no longer made so the entire door needs to be replaced.  I sent *** ******** a copy of the email and a copy of my original receipt from 2013 at which time the door cost $1,650.  So I told *** ******** I would accept the original amount of $1,650 for the damaged patio door.  He said he would think on it.

      As of today, January 15, 2024 I have received nothing,

      I have emailed the accounting information twice at this point. In reference to the door, it was very close to the holidays so I was having a hard time getting my handyman out there. When we spoke about the door initially, she told me that she would be OK with me cutting my commission by 10% in lieu of additional repairs - so that is where it was left.

      I am rejecting this response because:

      I have NOT received any "accounting" emails from *** ********, so how can I see that he only took 10%.  I don't believe him.  He waited too long before he said he did.  It was after I gave him the price for the patio door email.  I already had ***** **** * ******s look at damage that occurred on or before December 14, 2023.  I sent the email from ***** **** * ****** telling me that track for door is no longer made so patio door would have to be replaced.  I am giving *** ******** the original price of the door which was $1,650.  
      *** ******** needs to mail me the "accounting" info of how he came up with the $2,604 for the entire estate sale ie:  furniture: $$$, Coins: $$$, costume jewelry $$$, washer/dryer $$$, China $$$, barbie dolls $$$, tools $$$, etc $$$;  plus I want a check for $1,650 made payable to Schmidt Family Trust for patio door.  He has my address.

      I received a " Sales Proceeds" one sheet paper undated. See attached pic.  Doesn't have a fraction of what is gone.  See attached pics for my list that was taken during sale. *** ******** is claiming he kept on 20% instead of 30%.  Which according to his figures is less $325.50.  I sent him the suggestion of less 10% commission to repair broken patio door on December 31, 2023 but received no response from him.  On January 11, 2024 I found out from ***** **** * ****** that the patio door track could not be replace or repaired, the entire patio door had to be replaced.  All of this was emailed to *** ********.  The original price I paid for the patio door was $1,650.  Copies posted on last response and already emailed to *** ********.  I am still wanted the difference of $1,650 minus the 10% *** ******** apparently did not receive from his "Sale Proceeds", which is $1,324.50.  $1,650 minus $325.50 = $1,324.50.

      I am still waiting for *** ******** to send me a check to compensate me for the broken patio door.  We have finished the clean up which cost me more to haul away the trash left behind then was proceeds I got for all the antique furniture, coins, piano, paintings, barbie dolls, comic books, washer dryer, freezer, china, and crystal, plus silver plated flatware and gold plated flatware.  *** ******** is a con man and I was conned.  I always look and trust what the BBB shows on their website.  I suggest you give this one an F.

      I still may take *** ******** to St. Louis County small claims court.  I noticed on case.net it won't be ***** ****** ************ first law suit.

      *** ********, if you are reading this I want my check for my patio door which your brokers who were in my parents house alone broke.  You broke your contract the minute you gave strangers the lock box code without you present.  I will not go away without my check.

      After reviewing the clients request, ***** ****** *********** agrees to pay the $1,324.50 for the patio door replacement. A check will be sent by 2/9/2024.

      As for the items sold, I spoke at length with the client with her husband present, we specifically discussed Elite does not provide a breakdown of all things sold with a Broker sale. The buyers who purchase items at a broker sale buy in bulk (or a bundle) this makes it impossible to assign a price to each individual item in the bundle. The contract states an accounting will be provided which Elite has done. As to the value of items sold, per the contract signed by all parties involved, Elite has the sole right when determining pricing. This was also discussed at our initial meeting with the client and her husband.

      The client previously mentioned there was a lot for her to clean up in the basement. Elite was not hired to perform a cleanout of the home. We were specifically hired to sell what we could leaving the unsold items at the home. The client originally discussed selling the home as-is once we were done. The client and her husband liked the idea of not having to have the home cleanedout with this process. Elite offers cleanout services, however, this was not requested by the client. ***** ****** *********** assumes no responsibility for any cost or expense associated with the cleanout of the home as this was outside of our contract.

      Thank you for finally agreeing to pay for damaged patio door.

      In regards to selling home as is, you keep bringing it up.  I told you we had a realtor which sold the home for way more than your so called "investors" offers.

      You said you don't list sold items specially ie one pearl necklace, you would have costume jewelry.  My complaint was you let people in the home without you being present and you do not now what they took.  You told us you would always be present except the week of Christmas because you were going to Florida to visit your folks.  We were there when two men entered the home by themselves.  They said you gave them the lock box code.

      I still cannot recommend your estate sale business even though you finally after weeks of unanswered emails by me to you have agreed to pay for damaged patio door.

      I will be looking for your check in the mail.
