    We hired them to help us to get out of a timeshare. They said they would respond to us in 210 days but have not heard from them since our first visit. We started making payments to *** around $392 approximately a month. We would like our money back.

    Hello,

    Foxborough's only portion of the contracts you signed were for the ************** Points membership. The timeshare relinquishment was contracted through Resort Title Research  LLC who is located at ******************************************************* and their number is **************. I did reach out to them on your behalf and attached their notes of where they are in the process of relinquishing your timeshare. They did note that they are typically able to do it within 210 days however that timeframe isn't guaranteed. It does appear that they have been working on relinquishing your timeshare. Please call them at ************** for any further questions.

    ****** ****** states that in our contract #6 says it typically takes 2010 days for a transfer to take effect. #6 in our contract states "will occur within 210 days...." And this is underlined. This is why we are so upset with Switch It. We have paid our $800 (plus) maintenance fees to Blue Tree for the year 2024 and was unable to use it and now we have to pay 2025 maintenance fees and are unable to use it again.

    This complaint is false. Blue Tree Resort doesn't allow "Deed Backs". This has been explained to the client. The closing department has to market and sell the property to an approved buyer (by the resort) prior to the resort accepting the transfer. Unfortunately, this takes quite some time. The agreement signed with Resort Title Research and Switch It Title Exchange states the average is 210. Not that 210 days is the maximum or minimum. In July of this year, their property had been sold to a new buyer, but unfortunately they had backed out after closing documents had been sent out. Their property has been remarketed due to the first buyer backing out and the clients were made aware as of November 6, 2024. The file is currently being expedited for new ownership. The clients will be notified as soon as a new and approved buyer has been secured. 

     

    Regarding the clients statement of making payments to *** around $392, that is irrelevant to our process and does not have anything to do with Resort Title Research. Our service fee is $2,000 and the clients received a $100 discount by mailing a check payment for services. Our office received check #**** on November 8, 2023 for $1,900.


    I have attached a copy of the contract and below are the file notes from the closing department who are working the clients file, which indicates they have in fact been in communication since contracting;

    11/21/2023 SSM entered client info into ****. Emailed and mailed welcome letter.
    12/01/2023 SSM received docs and passed file to JL.
    12/07/2023 JL created and mailed LPOA to clients.  Scanned file docs and added docs and LPOA PreSig to Zoho.
    12/26/2023 JL rcvd signed LPOA from client.  Scanned LPOA; Created EN and added both to Zoho.  Sent rcvd LPOA email to client and passed file to ******.
    01/03/24 JS sent EN to resort.
    1/11/24 ** added EN to file and Zoho . Emailed client next stage expectations and passed file to transfer team
    04/18/2024 JL rcvd vm from **** asking for an update.  Explained with the transfer team, etc.
    7/15/24 - Sold to ****** ****** for 0 from *********. Passing to **** send buyer email and get with AW about the closing
    7/18/24 TDG Sent welcome email to buyer/***** ******. Waiting on response for SS#.
    7/18/24 TDG Received SS# from ***** ******.  File given to AW
    8/15/24 - AW mailed deed to seller w/ req for 150 xfer fee, emailed buyer to see if I can email deed to him.
    08/15/24 JS rcvd call from client - wanting update - advised in closing and she should rcv soon ^
    8/28/24 - AW rcvd excd docs from seller and check # ****. emailed buyer again, gave him 14 days.
    9/3/24 - AW called buyer and left VM, need docs. also sent him text through Zoho.
    9/5/24 - AW emailed buyer.
    9/10/24 - AW still unable to make contact with buyer, added to spreadsheet and passed to ****.
    11/6/24 - AW emailed update to seller, advised marketing since first buyer backed out
    We are having to remarket the account due to the first buyer backing out.

    I paid Resort Title Research, LLC $2000.00 which was charged to my credit card on 08-31-2023, They sent me the same letter about 8 times telling me what to do step by step, and I did everything the right way and I told them this. I spoke with ****** ****** several times she kept telling me they did a lot of work for me which they didn't, the people I was told to contact didn't know anything. I did some research on my own and completed all the paperwork myself. ****** would not refund my money, her manager called me and said I was not getting anything back, when I asked her what was done she could not say anything but we did a lot of work.

    Our office received the clients file and it was sent over to our closing department for them to begin processing the transfer. On 1/5/24, the client contacted me for an update on the transfer and I received communication back from our closing department that they had made several attempts to follow up so they could review their exit steps prior to moving forward. They had been sent an informative email on 11/14/23 and the clients never communicated back to their office. The information was then reissued, and the clients were asked to kindly reply to the email so they could pick up where they left off. On 2/13/24, I followed up with the closing department to verify if the clients had gotten back to the appropriate point of contact to which I was told no. The clients simply needed to communicate so they would be aware of the process and exactly what steps needed to be taken on their end. On 4/10/24, I received a call from Mrs. ******** asking for a refund stating that our closing department was not able to get them out of their contract. Several attempts were made to provide the clients with the detailed information that they continued to state they never received from November of last year, up until 3/26/24. On 3/26/24, the closing department received communication from the clients stating that they wanted to move forward on their own. Their office simply needed to confirm that the clients were ready to be contacted by their resort and were prepared to pay their exit fee. Essentially, the information the clients are stating they never received, provided detailed instructions on all steps to be taken to exit their contract. Unfortunately, we cannot move forward without communicating with the clients as it is necessary to finalizing the process. I informed the clients that there would be no refund issued due to it being no fault of Resort Title Research and our closing department. I hope this will help to resolve this issue.

    I am rejecting this response because: I followed directions on everything I was told to do, I contacted Ash ***** several times to let her know this, I was told I could not get my money back because I didnt do anything. Switch It sent me the same letter 6 times claiming to send more information but it was the same letter. Holiday Inn never contacted me about canceling my timeshare nor did they know about an update on my surrender. If you read the email or letter they are  telling you to lie because they know they cant do anything. I just want my money back. All of this is so deceptive.

    In effort to resolve the complaint, Resort Title Research had made the decision to refund the clients $2,000 service fee. Because the client did not pay the service fee to Resort Title Research, I contacted our closing department, Switch It Title Exchange, who collected the $2,000. Upon speaking with their office, I was made aware that the clients had charged back in mid-2024. Switch It Title Exchange won the initial dispute. The client then again charged back, and the merchant then sided in favor of the client. On 10/18/24, the client was refunded $2,000 back to their credit card plus $500 in arbitration fees. Please see the attached document reflecting the refund. This dispute should be resolved as our office never collected the fee and the client has been refunded. Thank you.
