    I have used this law firm several times and had no complaints at all while dealing with Mr, Pursley. However Mr. Pursley retired and left only ** ****** in the business. I was not comfortable with him at the first meeting, but a couple of dealings and he did what needed to be done until now. I sold some property and the buyer was paying all closing costs and chose *** ******. On Friday, May 13, 2022 I went into his office and signed all the paperwork. Everything related to that transaction was ok. I then ask if he had a couple of minutes to discuss something else and it would be billed to me. He said yes so I gave him the legal description of the property that my mother-in-law left to my husband, and a bank statement for money still in her and my husband’s name. My husband has now passed away and had not put my name on either one. I have people wanting to buy the property and I am unable sell it until this gets resolved. On Friday, May 13, 2022 he told me he had to have death certificates and ask if my husband had a will. I told him yes so he said he needed that as well. I provided the documents requested the next week. Original death certificates, the copy of the will. *** ******* told us when he created the wills to put them in a safe place and always use the copy for anything. ** ******'s office would not accept the copy. Insisted it had to be the original so the original was turned over as well.
    After 5 months and not hearing anything from them on October 26th I went into the office to inquire about the case in person. They could not find anything about the case. *** ****** was not in the office at the time. They took my name and phone number to call me when *** ****** returned to the office. After a week not hearing from them I called them. Their reply: "We have no record of anything." I made follow up phones calls with no results - sill looking.

    Our records indicate *** ******* was in our office on May 13 for a real estate transaction. The next point of contact was in late October when *** ******* dropped by the office to follow up on her late husband's estate. Office staff could not locate any documents related to her husband, ******, at that time. We have been diligently searching for the alleged lost documentation and have informed *** ******* of such each time she has called to follow up. Neither Mr. Porter nor office staff specifically remember receiving the original will, death certificate or any other information. Since there was no separate appointment made to discuss probate, it is difficult to determine the validity of *** *******' claims. Office staff continues to search for any and all documents that would be helpful in resolving this matter

    Office procedures are as follows: probate related files are purple in color, documents that are dropped off by clients are placed in a specific location, files that need more information from clients are also placed in a specific location and are followed up on regularly. Each staff member is trained to follow office procedure; however, staff turnover has been an issue lately. For example, one position has been held by three different people in the past year

    No file was created for the ******* estate and no probate related notes were taken, leading our office to believe that she simply asked generic questions while she was in our office for a different reason. This office does not believe we were hired to provide any probate services. Our office has not sent a bill and does not intend to for any probate services. Moving forward, if the original will is not located, probate proceedings can still commence and estate property can still be passed on to the heirs. *** ******* never tried to resolve this matter or inquire about possible alternatives in order to proceed. At this time, our office is not willing to represent *** ******* in any matter in the future due to a diminished relationship. Yours truly, MCNABB, PURSLEY & PORTER, LLC ******* ** ******

    I am rejecting this response because: At the original meeting I plainly stated after all documents were signed and the original reason for my being in the office was completed I ask *** ****** if he had time for a few questions - STATING IT WAS TO BE BILLED TO ME.  When he replied he did, I gave him the legal description of the property and an actual bank statement (not a copy) of **** ******* * ****** ******* to review.  Told him the problem and ask what I needed to get the property into my name so I could sell it.  Mr. Porter ask if I knew the value of the property.  When I said I did not he said he would have **** ******* to look at the property and give him the value.  He ask for the will and death certificates.  He personally kept the legal property description, bank statements and had written notes on his legal pad.  I then returned the next week (as that was a Friday afternoon) and presented them to the young secretary who is still working in the office as well as the older one.  The younger one i(I do not know their names) stated they had to have original documents.  The death certificates were but I had the copy of my husbands will.  She refused to take the copy stating it had to be the original.  I had brought it even though *** ******* had told my husband and I to use the copies for anything we needed the will for.  I went to my vehicle and returned with the original will and gave it to her.  I would think she should remember arguing with we over using the original versus the copy.  Why these documents were not properly file in what ever colored folder they use I have no idea, but they do have my originals somewhere if they have not trashed them.  Maybe they need to pull every case folder and paper they have touched since May 13, 2022 to search where my documents are.
