April 10th, 2024 my husband and I hired McGuire Heating and Cooling to provide **** services to our new home construction project. We supplied him the down payment of $6500.00 which was his requested amount from one of the 2 bids he provided us. He indicated he needed the deposit to purchase our unit from his supplier. However, our check was written to "***** McGuire" and cashed at his bank (OakStar) In *********, **. When our project was ready for the install, he set multiple times that he would come by and initiate install, then not show up, without communication. Then he did finally show up with one guy and they installed some duct work and braces then ***** stated he would be back the following week to install the unit. Again, he set multiple days/times he would show up and one was even a Sunday. Then he never did, we called him and told him we no longer wanted to work with him. We took down all the duct work and returned it to his office, which he acknowledged in a text message. We set up a time to meet at his bank to obtain our refund and he never showed up. He stated he was waiting for his supplier to provide our money back to him for the unit he purchased. He stated that he would refund our money if he was not able to get his supplier to refund his. Then multiple excuses later, he finally stopped contacting us. To date he has not refunded our money.Initial Complaint

Had a new Heat and Cooling system installed September of 2022. The thermostat was installed incorrectly which caused the heat to not shut off. While out of town the thermostat was set at 69 but was over 100 degrees in the house for multiple days, October 2022. When we returned we contacted the business and they fixed the thermostat but the Vinyl flooring was damaged. Owner agreed to have it fixed, after 6 months of promises that someone would be out or that it was turned over to his insurance, still no resolve. He would not give me his insurance and claim number. In April 2023, they came and installed 2 air conditioners upstairs. They were to cover 2 black pipes on the outside of my house. I have made 20 calls for them to come and do this but they have not shown up. I guess he thinks I**;m a little old lady he can take advantage of but he can**;t do it. My home association doesn**;t like the way my home looks. The air conditioning upstairs looks great and the covers for the pipes have not been done. I would like for him to finish the job and cover my 2 pipes.Customer Answer

***** ******* was to install a new HVAC system at my lake house on *** **** **** in Stover, MO for $9766.10. He required me to pay $5,000 in advance in order for him to purchase the equipment. The rest of the money was due upon completion. I mailed a $5,000 check on October 28, 2022. The work was to be completed in November. ***** has not done a single days work on the property. In fact, he hasn't stepped foot on the property since then. I have received nothing but excuses and unfulfilled promises. I eventually grew tired of being lied to and started asking for my deposit to be refunded. Tommy has been lying and making excuses for months and I still do not have my money back. It's now been over 6 months and I am out $5,000 and have no HVAC at my house. This man stole $5,000 from me. I believe he should pay me back, plus interest. I do not trust him to mail the check. He has lied twice and said the check was mailed and it was never received. I believe he is making up lies like this to buy time because he likely spent my money. He should wire the funds to my account immediately. I have attached the text messages and the bid and the check.Business Response

I am rejecting this response because:
The business owner has lied repeatedly for months regarding mailing a refund check. He keeps saying there is a check in the mail, check lost in the mail, about to mail a new check, etc. I have offered to meet him to accept payment in person or get him wiring instructions and he keeps saying the check is in the mail. I believe he is just lying. I will literally get in the car and drive 3 hours to pick up payment, if need be. I just want my money back. He has been lying to me for months and now he is lying to you, as well.

We hired the company back on August 21, 2022 to do a complete HVAC system, including new lines, holes, new AC/furnace. They told us it would only take 2 and half days. To this day, it has not been done. We terminated with him on October 24. They worked maybe a total of 12 hours in that time frame. They kept coming up with excuses. The only equipment they have here is the coil, duct materials and the heater. We told him we would just part ways and they can take their materials. I paid $7750 to him so far. Now he is trying to force me to have him do the work. I did sign the contract but he told me it would only take 2.5 days not 6 weeks.Business Response

I am responding to a complaint from a customer ***** ****. I am attaching the letter sent to Mrs. ****** address certified mail on October 31, 2022. That letter was a breach of contract letter sent to Mrs. **** after she called me on Saturday, October 22, 2022 and verbally told me not to return to her residence. The unit, equipment, supplies and duct work that was all hung and ready for install was left at the residence along with three brand new ladders and other tools needed for the job.
The attached breach of contract letter was delivered to Mrs. **** and we have not had a response to said letter. Any further questions, please do not hesitate to reach out to us.

I am rejecting this response because:
The certified letter that was sent by me was rejected by them, unopened. I'll provide a photo as supporting documentation. There is a heater and a heater coil and some ductwork that was left on the job. It will be used to finish up the heating, by another company. It was five weeks that they were here on the job but they only worked about 11 hours total. He continued to not show.
