    In early April of 2022, Concrete By John LLC installed a concrete driveway and sidewalks. In mid July, I contacted the company owner by email and indicated the finish on the front sidewalk was very spotty, did not look good, and was not like the broom finish on the rear sidewalk.. I also indicated that the front sections of the driveway looked very rough and was nothing like the fine broom finish that they applied to the upper sections of the driveway. I included pictures of the spotty front sidewalk and the rough finish on the front sections of the driveway. The work proposal clearly indicated "concrete to have broom finish." The owner responded that he would come by when he was in the area. In late July, I again contacted the owner by email and indicated that I wanted to be at home when he planned to come by. He never came by and did not respond. In early August, I sent another email to the owner and repeated the concerns I had with the finish on the front sections of the driveway and the spotty front sidewalk. The owner responded by email and indicated that I said that everything looked good when they finished and that the proposal states that they were not responsible for color quality. I responded by email and stated that at no time did I indicate that I was not satisfied with the color quality of the sidewalk or the driveway and reiterated that the problem was with the spotty front sidewalk and the lack of a broom finish on the front sections of the driveway. The owner has not responded.

    To Dispute Resolution Department,

    I am responding to complaint by *** ********. Upon completion of the sidewalks and driveway *** did not have any complaints at that time. All concrete has a broom finish. There were no spots on the front sidewalk when we left the job. I reviewed the pictures he sent in July and cannot explain the spots two months later. The contract states I am not responsible for color quality.

    I am rejecting this response because:  The spots appeared on the front sidewalk with a few days after the concrete was poured.  We had hoped the spots would gradually disappear but they have not.  The poor finish on the front sections of the driveway have ridges and look rough. The finish looks unprofessional and is completely different than the broom finish on the back sections of the driveway.  The color of the concrete is not the problem.  I had asked the owner to come by and look and the problems. He said he would come by when he was in the area however, he never showed up.

    I contacted ********* ***** *** and they sent their representative, **** ******* to look at the sidewalk. He stated that it is rock shadow caused by difference in moisture content just above a flat side of rock causes a difference in color.  It usually fades completely as cement in the concrete continues to hydrate.  He has seen it take an entire season to go away.  It is nothing I did or anything wrong with the concrete.  He will be emailing an assessment document asap.

    I will contact the homeowner today to set up an appointment to look at the finish on the driveway.
