    Date of deposit for materials in amount of ******* was 10/15/2022 .Couple days later before materials was purchased we decided to go with Trex decking. So he figured up an estimate of ********, which ******* was for labor, it said material cost may change but labor will not. I went to Lowes I had them do a bid for all materials and decided to go ahead and purchase. Which he had no problem with it took 10 days to get material which was delivered on November 10 2022. He started job on December 1, 2022 and sent me a message that the old decking was harder than he thought to remove and he was changing labor cost to *******. I told him we needed to discuss this because it was ******* more he said it was nonnegotiable I had my son call him because he wouldnt answer his phone or my texts. My son told him that the estimate did say labor cost would not change, which my son understood that he probably did underestimate the job but ****** would continue with the job and honestly I was willing to pay more depending on how long it took him to finish. He kept promising to come and when that time came he always had excuses why he couldnt come like he hit a deer and his truck was at the shop but I know for a fact he has 2 trucks and it was the same old thing excuses every time he was to show up. I got tired of his excuses because the upper deck had been without railing for over a month he worked that one day and never came back. I told him week before Christmas wanted it done by the end of year or I want my money back. He said I didnt sign a new contract and sent another over thru text and it was 13, ****** total ******** for delay and ******* that I gave him. We are not willing to pay someone that cant show up and change how much he wants 3 times. So I got someone else to do the job, it took one guy 4 hrs to tear off half the deck. He wont return my money I even offered him to keep ******* and return the rest. Now his saying his suing me for breach of contract.
