    On 11/29/21, I contracted with **** Pudivitr to do work on my house. I have attached a copy of the proposal and copies of the front and back of my deposit for $2,475 (50% of the total cost).Weather permitting, **** planned to begin work, possibly as early as 12/7. During December and January, **** postponed the start date several times; I had no problem with that.On 1/27/22, I asked **** to patch a hole that a squirrel had made in the drywall of my bedroom. He said he would do that the next day and would come again on Monday to more closely figure the materials needed for the original job. He neither came nor called on Friday or Monday. I waited to see when, or if, he would contact me.In mid-March, I called **** to see about proceeding with the original work. He said he would come on 3/21/22. When he didn't come or call, I realized that **** was undependable and that I didnt want him to begin the job I had contracted for. On 3/30/22, I let **** know that I would be unable to have him do the work, and I asked him to refund my deposit. Despite trying to reach **** by phone, e-mail, and certified letter (though not so frequently as to be harassing), I heard nothing from him until he called me from the hospital in early June after a near-fatal auto accident. **** said he would get the money and call me in early July. He did not call.Near the end of 2022 I immediately accepted ****'s proposal that he repay me in installments. By 3/24/23 he had paid me $1,370. He had planned to make a payment on 4/26/23; however, I have not heard from him since 4/20/23. I last contacted him by e-mail on June 14 and July 15. During the past two years **** has had two serious auto accidents and perhaps other medical issues. He has apologized for his lack of communication and of payment. He has acknowledged that returning my deposit is the right thing to do.**** and I agree that he has repaid $1,370 of my deposit and owes $1,105, which I am eager to receive.
