    My husband and I hired *************************** of C&J painting to remodel an upstairs bedroom on an insurance claim in August of 2023. He was given approximately $4200 to start the tear out and remodel. He accepted the job for the amount agreed and began the tear out. This was an insurance job. He agreed on the terms that once the job was done he would receive the remaining $1100 from the recoverable depreciation check coming from the insurance company. He tore everything out, and hung most of the drywall back in fall/winter of 2023, then never returned to finish the job. My husband and I, along with multiple people from our insurance company have contacted him on multiple occasions, and while he has said he would show up almost every time, he never did. We ended up having to finish the repairs ourselves within the year date of loss on July 19, 2024, and we still have yet to receive any communication from ******************.

    There were two proposals given which totaled $8012.27, I was only given $4200 with the remaining being paid of $3821.27 when the repairs were done, if more needs to be done that's not apart of proposal/contract they would be charged at $55.00 per hour for the job plus the cost of the materials, she agreed for me to do the job. When I was half way done, with about 12 hours of labor left to do, and carpet was needed, the husband stated that he could not get the carpet at the time and would call me when he did and would pay me the balance when it was completed. There was a chimney removal and a closet removal with drywall replacement and insulation done which I later found out by their insurance company when they called me to close out the claim that those repairs and any other extras should not have been done without being approved by the insurance company and another adjuster coming back out. I have tried to speak with the husband ****** about all of this, and I have been threatened which was sent to via text message. I was never paid my balance of $5291.27, therefore I will not be issuing a refund.

    I have reviewed the business' response and am rejecting it because:
    ****************** received 2 checks totalling 4500 to begin the project.  I never seen any amount of over 8000 worth of proposals. There was a chimney and closet removal which I told ****************** numerous times all he had to do was issue an invoice with extra labor hours and materials and he would be paid for those. He never submitted any receipts or invoices for this, therefore he wasn't reimbursed for this. Also, he was contacted numerous times by my insurance company, my husband and myself to try to get him to finish the room so we could pay him, but he wouldn't return to finish the job. There was even one time my insurance adjuster tried to communicate with him to let him know the last agent he talked to was incorrect about submitting receipts, and ****************** hung up on the adjuster to our claim! All these calls from the insurance to/from him were recorded as well.

    I have checks that were paid to me by the consumer for approved repairs. The $2000 was towards the total of the 1st proposal, the $2500 was towards the total balance of the second proposal which both checks reflects that. She still owes a remaining balance to me over $6000 for the work that was completed.  Any of the extras that were not approved by the insurance I still completed it and I was not paid for that work. Consumer had received copies of both proposals which is why the checks paid to me were dated after the dates of each proposal dated that she received from me.

    I have reviewed the business' response and am rejecting it because:
    The job was never to be with both proposals. The second proposal was to replace the first. The first proposal was "****** out" at the bottom due to him copy and pasting over the top of a different customers proposal. I never said he wouldn't get any money for his extra work. I said on multiple occasions that he need only submit invoices and receipts, which he refused to do. That is why he didn't get paid. Also, the insurance is not going to pay completely for a job that is not finished, nor am I. There was way more than 12 hrs worth of work left to do. The drywall was not even completely hung. The taping, sanding and painting all still needed complete, as well as all the electrical outlets, light/fan and switch.
