      I have been a tenant through Millsap Properties since January of this year, 2023. Shortly into my residency here my apartment started smelling like raw sewage. I contacted maintenance and they stated that they're aware of the problem and are trying to fix it. I talked to my neighbors and they're smelling it as well. My neighbor below me had told me that the smell has been occuring for around a year. The smell continued for a couple of months and I finally reached out to the property manager and made her aware of the issue and she stated that whenever it happens to give her a call. I revived a voicemail from her saying that there where a few things she wanted to discuss with me. I tried to call back for a couple of days but the voicemail box is full. Then the number was completely disconnected. I have emailed the property on Friday and haven't heard anything. I decided to call the number that's in the sign out front and that voicemail box is full as well. The smell is occuring do much and so bad that I have become physically sick with an upper respiratory infection. I want up with massive migraines everyday. When I first moved in this want an issue a rarely ever got sick.
      So I took it upon myself to only pay partial rent last month. My late fee are started to rack up and im trying to get a hold of somebody to talk to them to get this issue resolved but I'm not getting any responses.

      Attached to this response is the last maintenance request we have received about this issue.  Please refer to the actions log and notes sections from my maintenance staff.  I also had all the drains flushed with proper chemicals, I had AA Quick Plumbing camera the drains looking for breaks which there are none, and they snaked all the drains making sure they were all clear which they were.  A tenant had a broken washer down there we made her get rid of which could have been the source of the smell.  After we did all of this nothing has been reported since.  

      Maintenance is in that building almost every day, my manager is in that building checking the drop box weekly, I am in that building weekly, and we have never smelled it. I went by there today before responding to this complaint and the building smells great.  The tenants were told to call the emergency maintenance number if they smelled the odor again because it was not a consistent odor. It only happens every now and then which is why they need to call the emergency line so we can come right away to see what the issue is because we never smell it. Not a single tenant in that building has put in another maintenance request for the odor nor have they called the emergency maintenance line since 4/12/2023.  We cannot fix what we do not know about.  Until the odor is reported to the emergency maintenance line so we can smell it we consider this maintenance issue complete.  If it is still a problem it is probably a tenant caused problem and we will take different steps to address the issue. 

      My personal opinion is the customer who filed the complaint cannot afford to live here and is about to be evicted so she is looking for reasons to not have pay which will not hold up in court.

      Millsap properties recently acquired the apartments my son and I have been living in since April. ***** ******* himself chose to sue me for being 1 month behind. Fees and such have led him to thinking he can charge me almost $1200 a month on an apartment that I agreed to pay $720 a month for. Late fees for one month per the lease total $110-112, so ˜ $830. Now add the court and filing fees every month and it's $1190.75 PER MONTH. This is obvious predatory landlord behavior. My complaint is that a window was broken, open wide broken, which they did show up to board up but did such a terrible job, there was bugs, hot air and cold air flowing freely into my apartment. I was told on October 18th 2022 the glass would be replaced. NO ONE AT ALL has come to fix the glass at all and now (11-17-22) they are trying to charge me $697 to replace the whole window. The "maintenance" man that boarded it up had no clue what he was doing (he also caused a flood in my unit due to incompetence) and I do not trust him fixing anything I have to live with. This complaint is about unethical business practices and I'd like Millsap Properties to apologize and stop trying to sue me.

      To whom it may concern,
      It is our policy, like almost every landlord, that when a tenant is behind on rent we start the eviction process. Ian admits in his complaint that he is one month behind. He currently owes $2,098.49 with December rent due next week so of course he is being evicted. Every charge on his ledger is allowed per his lease.  Per his signed lease, which is enforceable under Missouri State Law, he is responsible for all lawyer fees, court costs, late fees, and tenant caused damages.  All he has to do is pay his balance to zero and the rent and possession case will be dismissed. 
      The broken window is broken because Ian kicked it in to gain access to his apartment because he was locked out. All *** had to do was call the emergency maintenance phone number provided to him and every other tenant and maintenance would have come to let him in. He could have also called a locksmith.  Therefore, *** is responsible for the cost of repairing his window.
