    Our church entered into a contract with ********************* of Dirt and Demolition LLC on Feb 26, 2024 to clear all vegetation from a portion of our property, with the exception of 6-7 large trees. The scope of work included removing all debris and property, grading all areas disturbed by clearing and then seeding and strawing the area. Payment has been made in full. Work, was partially completed in April, but as of this today, June 27, 2024, the work has not been completed. Cut trees and brush have been left piled on the road (a cul des sac) and the city is requesting that the pile be removed. We have had many conversations via text and email with ************** and he continues to delay and make excuses for not completing the work. He has now stopped returning our messages and as of last week no longer has a voice mailbox set up on his phone. We would like a billing adjustment as the members of our church must now complete this work to meet the expectations of the city. We will also need to rent trailers, dumpsters, and chainsaws to complete the work while putting members of our church at risk for injury. As with previous complaints, he has claimed medical issues, but that is not relevant. If he needs to outsource the work, then he needs to do so and follow through with his contractual obligations.

    I went above and beyond. I gave them the original price of $5860 and then they added more ground to be cleared. The said they would take care of the 5 or 6 extra trees. I will send you a screenshot of their text telling me the "Men" of the church will take care of on a Saturday

    We received the initial quote of $5,800 on 2/26/24.  The scope was to clear all vegetation from an area except 6-7 large trees.  The company was to remove all debris and vegetation as part of the contract.  Additionally, the company was to grade all areas disturbed by clearing and then seeding and strawing. 

    During the project, we asked for a quote for additional work, which was to load clean 4"-6" rock for a spillway off the edge of the parking lot and to add fill dirt to 2-3 low lying areas.  The company provided a quote, in writing, for this additional work of $1,180 and we agreed.

    During the project, we asked for another quote for additional work, which was to create a culvert for the creek.  The company provided a quote, in writing, for this additional work of $950 and we agreed.

    During the project, we asked for another quote for additional work, which was to clear the vegetation back further than was was scoped during the initial bid.  The company provided a quote of $1,400 and we agreed.

    So throughout the project, we did ask for additional work.  The company provided us with quotes for the additional work and all parties agreed.  At no time did the company indicate that he was losing money on our project and ************ personally provided the quotes for the additional work.

    The grand total for all the work to be completed was $9,330.00 and all monies have been paid. 

    On 2/27/24 we paid the company $3,500
    On 3/4/24 we paid the company $1,800
    On 3/7/24 we paid the company $2,630
    on 3/11/24 we paid the company $4,030

    In total we paid the company $11,960, which included an overpayment that was an error.  We subsequently asked for the company to refund the overpayment, which they did in the amount of $2,630.  Thus, we paid the company a total of $9,330 from 4 separate requests for work.  We have fulfilled our end of the contact with payment in full, yet the company did not complete the work.  We should not be penalized because the company underbid the project and ended up losing money and failed to speak up.  The company had opportunity to costs when preparing quotes for additional work.

    As mentioned in our initial complaint, the company did not complete the project in a timely manner and left a pile of debris on the cul-de-sac.  We attempted to reach out to the company over the course of approximately 2 months by phone and by text for him to complete the project.  Eventually he stopped replying and his voice mail stopped allowing for messages to be left.  We were receiving requests from the city of ************** to clean up the the brush pile on the cul-de-sac and made the company aware of those requests.  We had to complete the work ourselves and made the company aware of such in text message.  We were forced to do the work ourselves of face fines and penalties from the city.

    Again, all monies have been paid per the contract.  The company did not fulfill their end of the contract, and we were forced to finish the work ourselves.

    I am almost speechless for my response.  First of all I never had any conversation with ******************. I have no idea who he is. Obviously he must be a member of the Church. He was never involved with any of the conversations with  me in regards to additional work to be cleared. I cleared much more vegetation than was discussed even with additional charges. With the additional areas to be cleared involved several large trees which I was told by ****** and ***** that I could tuck away further back in the property, which is what I did. Then towards the end of the project I was asked to pull out the larger trees and haul them off. I did this and at my cost hauled off most of the large trees leaving a few 3-5 behind.  In addition ****************** is not aware of the Church asking me to remove a old compost pile that had accumulated over the years, leaves, cut grass, twigs, branches, etc. I did this by pulling all of this debris out from further in the *****. At this point I do not know what the Church is wanting from me. EVERYONE  from the Church complimented me for how the clearing transformation was absolutely incredible. At this point I do not know what else to say to this complaint. I am at a loss for any other comments to share. I am done with going back and forth over this matter. The transformation was way beyond the Paid scope of work. I know this and so does the church.

    ****************** is the Financial Secretary for the Church.  He works closely with Pastor ********, Council President *************************, Property Chairman *****************************, and the other council members on all church matters.  He speaks for the church in regard to this complaint, although we do not understand how that is relevant to the situation. 

    The fact remains that ************ and his company, Dirt and Demolition, was hired to perform a job for the church.  The initial quote was for $5,800 with options for additional work.  ************ is correct in stating that additional work was requested.  Each time additional work was requested, ************ provided a price quote for the additional work, the work was added to our invoice, and the invoice(s) have been paid in full.  Yet the work was not completed.  Both parties agreed to the scope of the initial work request and all additional work requests.  Additional work was invoiced to the church and the church completed it's end of the contract with payment in full. 

    ************ is also correct in that the work performed looked incredible.  However, a large pile of brush was left on the ********** and was not cleared by ************ and/or his company.  The contract specifically stated "Remove all debris and vegetation".  We made many attempts to resolve this situation over the course of several months.  As stated, the church was getting requests from the City to remove the debris from the ********** or receive fines.  ************ was aware of this.  Attached is a text with ************ from May 21, 2024 whereby ************ acknowledged the work that remained to be completed.  He promised that it would be done in the next 7-10 days.  He complained of health issues and the lack of funds coming into his company as reasons for not completing the work. 

    Two full months went by and the work had not been completed.  ************ stopped answering his phone and eventually we were unable to leave him a voice message.  As a result, members of the church were forced to complete the project to avoid fines and penalties from the City.  This required expenses for chain saws, dumpsters and trailers to remove the brush, in addition to many hours of labor from our members. 

    As stated in the initial complaint, we are seeking a partial refund of the monies paid to ************ to cover the cost of our expenses and labor.  ************ keeps stating that he lost money on this job.  It is not the church's fault if ************ underbid the work or failed to properly manage the project and his own expenses.  The church should not be penalized for his errors and/or failures.  We are seeking a refund of $1200 to avoid litigating this matter in court for breach of contract.

    I really have nothing further to say. Yes, indeed I lost money on this job and indeed as ****************** stated the work that was performed was INCREDIBLE.  and it is. I drove by the Church a couple of weeks ago and now see beautiful grass growing over the acres that I cleared and noticed that in the Cul-de-sac ALL of the debris are gone. There is nothing more that I can do. I have NO monies to contribute and if I did I would not pay anything. I went ABOVE and BEYOND for this Church in good faith and did a OUTSTANDING job.  I feel at this point I am now being harassed by ******************. I am NOT going to be bullied anymore by the Church asking for $1200. That is TOTALLY INSANE and is not, will not happen. Truthfully I am SPEECHLESS on how a Church is beating a dead horse in the ground.  I am done. Please do not contact me anymore.  The audacity of the Church asking for money absolutely puts me in total disbelief after all that I did.

    Work began in September of 2023. To this date, work has not been completed. Payment has been made in full. The contractor has made multiple excuses for not finishing the job and continues to make more. He misled me by telling me a railing that goes across the top of the wall had been ordered and just needed to be picked up. It has not been ordered. He led me to believe he owned the excavator he was working with, but it was actually rented. The owner of the excavator actually came to our house and picked it up. The rental company he got the concrete molds from for the wall also came to pick up the forms he used. That company threatened me, saying he would file a lean against our house. I believe that business will also be failing a complaint with the BBB. I want a billing adjustment or completion of the job as listed in the contract.

    There is some partial truth to this complaint.  ********************* knew that I was going through problems with employees.  It came to a point to where the employees were paid, one found another job, and I had no workers to finish the job.  I have a heart condition and am 68 years old and couldn't finish the job myself.  As far as the rental of the skid steer, that is not relevant.  I went through Covid after this job has been started.  He is still holding $10,000 worth of my tools, told him to hold on to them until I got back to finish the work.  He can send the pictures of the tools, one of them being a laser - an instrument used for grading work.  I filled in his swimming pool, graded the backyard, finished his patio, poured the footing for the retaining wall and the retaining wall, the 5 big flagstone steps are there, the slope of the work needs to be dug out by hand so as far as the $15,000.00 amount, most has been absorbed by what has already been done.  I didn't realize I would be short of help.  Then we got into winter and they were out of state for a month or so and I didn't have access to the tools to finish the work.  Now that the weather is breaking I will be getting this wrapped up.  As far as the work that is left, it is 15% of the overall job left to be done.  I talked to the fence company and by the time it was ready to get the fence railing, I had no one to install it.  The item of the fencing is $1,000.00.  The only thing that needs to be done is a couple sections of fence railing to be put up on top of the retaining wall and rich top soil that needs to be spread out over the yard.  All the drain tile has gone in.  

    He has between $8,000 - $10,000 of my tools in his house.  These are tools I would use on a daily basis so obviously I have not been working.  It is not because I don't have all my tools, it's because I can't find good help these days.  I'm working on this.

    If he would like to make an adjustment of $2,000 - $3000 cash and for me to pick up my tools, we can do this if it would be fair to him.

    Dirt and Demolition had a job cutting a tree down for a neighbor of mine. While I was out of town this company drove over my property crushing my drain pipe from my gutters and ran over my flower bed causing damage to ligt and flag.

    The company then without securing the tree properly and the tree ended up falling against my home.

    I took down a tree for a absentee home homer at *** ***** **. which is next door to the complain tee.  The tree never touched his house, this individual **** ********* has harassed me to the point the **** *** ***** ****** ********** got involved.  This is all a to make  financial gain off of my insurance.  The consumer stated that he has video of this.  The only thing that happened was a limb knocked down a yard flag.  Also, the retaining walls were not in *********'s yard when we completed the job.  This has gone from ********* wanting $10,000 to $4,000 and now to him wanting $540 for BBQ grill.  Please reach out to Sgt. ***** with  **** *** ***** ****** ***********
