      On 12/27/2023, I purchased a 1966 ********************** 250H motorcycle from Homsher Restoration LLC dba "IT'S ALIVE!", **************************************************************************The salesman, *****************, told me that the motorcycle "started right up" but the transmission had seized. I agreed to buy the motorcycle and have the business arrange for shipping.The purchase price was $3,000 which included credit of $300 for shipping.When I received the motorcycle, I discovered that the gas tank itself, the petcock, and the carburetor each leaked seriously. The condenser was fried. There was not spark to the plug and the compression tested only 50 psi. The oil sump was full of extremely gritty sludge and gasoline pollution. In short, the motorcycle had obviously not been operating for a long, long time and certainly was incapable of "starting right up." It requires an estimated $2,500 of repair work to the crankcase and motor. When I contacted the **** **********************, owner of the business, he tried to convince me that his technician had ridden the motorcycle in their parking lot. He said he would verify that and get back to me.He has not gotten back to me and has failed to reply to my repeated emails for a month now. I am 73 years old and my spine and shoulder disabilities kept me from travelling to actually see the motorcycle when I purchased it. I understand that I made the mistake of purchasing this motorcycle in as-is condition, relying on the integrity of the business to represent the true condition of the motorcycle.I am disappointed in the way that Mr. ********************** and his employees misrepresented this motorcycle. I requested that Mr. ********************** offer a partial refund in the amount of $2,000 as the bike is worth an estimated $500 for parts as-is.

      This motorcycle was 1) accurately represented, 2) sold in as is condition, and 3) the contract signed by the purchaser clearly states the two previous items as well as the fact that the customer is fully responsible for performing their due diligence and they should not rely on the presentation of the company or it's representatives because the condition of classic vehicles is incredibly subjective and must be evaluated by the purchaser.  In addition, approximately 6 months prior to the sale we drove the bike around our parking lot with no leaks and running very well (however it was at that time that the shift linkage failed which he was informed of and states).  Furthermore, the customer stated that he wanted a bike to tinker-with and was not concerned about the linkage.  Lastly, he did not contact us for many months after the sale.  I wish he lived closer as I would gladly go look at the bike and assess the current condition as to whether I would buy it back.

      I am rejecting this response because: 

      It is impossible that the motorcycle was in running condition as represented by the seller.  The compression measures only 50 psi.  The condenser was inoperable and unable to provide ignition.  ******* tank and the fuel valve leaked fuel immediately and severely.  The carburetor also leaked - horribly at every gasket.  Claiming that this motorcycle was started and driven is completely implausible.  

      I am not complaining about the inoperable transmission.  That was disclosed. 

      I understand that the seller sold the motorcycle as-is and the seller has no obligation to stand behind the sale.  I should not have trusted the seller to accurately represent the motorcycle's condition. 

      I want others to understand that this business misrepresented the condition of the motorcycle to a disabled 73 year old man who could not travel to do my own due dilligence.  

      Fool me once....

      My husband wanted to surpris* m* (as I was going through chemo for a diagnosis of leukemia diagnosed 6/22) and h* proposed that my 1973 Triumph hav* som* issues corrected (exhaust fum* odor, oil leak and replac* top). I excitedly agreed as this was my reason for not driving my car. My car was transported to It's Aliv* Auto on October 26. My vehicl* was picked up at my residenc* at 10:21 am. As you can se* from photos, th* top was down. Original top boot was on th* car.

      Car total amount du* after extensiv* amount of work was clos* to $15,000.

      Car was finally completed and picked up mid part in December. After driving hom* in th* car (of cours* top was up...it is December), th* car still smelled lik* fumes. I contacted It's Aliv* Auto and **** (owner) set up a tim* and cam* out to check th* car. H* stated that th* transmission tunnel cover had som* holes and needed to b* fixed. I also noticed som* oil leaks underneath th* car. Car was dropped off again via *** to th* It's Aliv* auto facility on January 19th at about 9:48 am.

      Car was finally hom* and kept under a cover.

      I completed chemo treatment and feeling so much better that I decided to visit a relativ* and enter th* car in th* Fiesta in Florissant Car Show 6/24. I placed th* top down and opened th* trunk for th* boot and noticed that th* boot and tonneau cover wer* not in th* trunk. I knew that th* tonneau cover has always been in th* trunk if not on th* car...sam* for th* boot. I contacted my husband and h* asked m* to check th* trunk again. No covers....

      I left a messag* at It's Aliv* Auto several times and did not receiv* a call back. I drov* up th* facility and spok* with ****...as well as with ****. I was offered a boot that DID NOT match my car's interior. I was told that I would b* kept abreast on th* location of my boot/tonneau cover. They gav* my husband on* but it does not match. I want my covers returned or replaced (that MATCH).

      I want to driv* my car...top down.

      earlier.  I receiv* a lot of emails and many ar* spam and
      overlooked.  

      The
      sequenc* of events as described in th* complaint is very accurate; unfortunately,
      as w* hav* described to ********* many times, ther* ar* a number of reasons that preclude
      our business from being held responsibl* for th* loss of her boot cover.  Whil* I’m extremely confident that w* did not
      remov* th* covers and that they wer* not stolen or lost at our facility, the
      overarching reasons that w* should not b* held responsibl* for th* loss ar* that, 1) ********* signed out Work Authorization Document that explicitly states
      that ******* Restoration LLC can not b* held responsibl* for any items left in th* vehicl* (I reviewed this document with Esperansa), and 2, as ********* stated in her complaint, th* loss of th* covers was not recognized for over 6 months after sh* picked up th* vehicl* (over a half year had passed befor* ********* informed our business that th* covers wer* missing).  Also, ********* informed us that during that 6 month period sh* was going
      through substantiv* health and family issues which amplify th* probability that th* items wer* lost or stolen during that period (not by our business).  W* hav* spent countless man hours looking for her covers and no on* has ever seen them (our Team prides itself on ethics and frankly would hav* no need for thes* items).  All combined, I believ* it to b* very unfair to penaliz* our business for this event.  

      That said, ********* is a very nice
      lady and w* do not want her frustrated with us.  If
      sh* comes into th* s*** and picks out th* specific boot cover that sh* wants
      (needs to pick out th* color), w* will purchas* a new boot cover and install it on
      her car for free.   I believ* that approach to b* mor* than fair all considered above.  I pray sh* does as well.  I'm a believer that what goes around comes around so I w* want to mak* this right.

      I am rejecting this respons* because:

      Th* boot was in my vehicl* when TOWED to th* facility. Th* weather was cold…too was up. Boot is an accessory that is always with th* vehicle. Why would I remov* th* boot to keep in my home???? Absolutely insane. 
      I feel that I was taken advantag* of by “It’s Aliv* Auto” becaus* of my illness. Why would I driv* with th* top down during winter whil* undergoing chemotherapy for leukemia?? 

      I also feel I was taken advantag* of becaus* of my race. I am a Hispanic femal* and I feel that I was not treated fairly in how my property was handled.

      I want th* boot and tonneau cover replaced.


      I am appalled at th* facility’s response.

      Attached pleas* find a video of *** picking up th* car to tak* to It's Aliv* facility.  As you can se* by th* video, th* top is down and th* boot is on th* car.  I hav* included a screenshot of my phone.  It is dated.
      When I picked up th* car (after completion) approximately a month or so later, th* new top was up.  I did not hav* a reason to look in th* trunk for th* tonneau cover or boot.  I didn't giv* it a second thought...it is a car accessory, why would I look in th* trunk to ensur* th* boot/tonneau cover wer* still there?
      I picked up th* car when it was cold outside. Why would I driv* with th* top down? I was sick from th* meds...top down would not hav* been saf* for me.

      I believ* out offer to replac* th* boot cover was mor* than fair considering that 1) ther* is zero proof that th* boot cover and th* tonneau wer* not in th* car when it was picked up,2)  th* customer signed our work authorization document that specifically stated that our business is not responsibl* for any items left in th* vehicle, and 3) that th* customer did not inform us for over 6 months that any items wer* missing.  Any on* of thes* items is sufficient to preclud* any action on our part and in total thes* items provid* an immeasurabl* defens* in any responsibility (again, th* customer signed our Work Authorization Document specifically stating w* ar* NOT responsibl* for any items left in th* car).  Yet with all that said w* agreed to replac* her boot cover in good faith. 

      W* try very hard to b* fair.  I believ* w* ar* her* so I suppos* we'r* at a stand still.
