    The contractor was hired on 9/22/23 for a renovating 3-bedroom, 2.5 bath house in ********, **. The cost of the rehab including material and time was $35,000 planned to be completed within 60days which was later agreed to be done at $30,000 verbally upon negotiation. 50% of the total cost was paid upon hire. A second payment was requested during progress for the amount of $8750. An amount of $10,000 was paid on 09/30/23 during the progress of the work and an additional payment of $5000 was made on 12/26/23 when the contractor said he did not have money to complete the work. The scope of work included materials, permits, and labor costs. however, the contractor had asked me to pay for flooring materials for the basement which added another $2000 towards the rehab. An additional $2000 was requested to complete a half bath in the basement which was originally included in the bid however was agreed verbally to be paid upon completion of the project and the punch list have been completed. All the payments were done in a timely fashion, given 6 months for the contractor to complete his work which was supposed to be completed in 60days however the contractor failed to complete work in a timely manner and failed county inspection for not installing kitchen receptacles, inoperative toilets, defective smoke detectors, exposed electrical wiring and basement leak. Final product was not up to code and was in violation. The real estate agent who has been walking the property provided punch lists of what needs to be done to get it sold however the contractor failed to get the house ready for county inspection. Additionally, the realtor reported finding a rifle bag at the house during the realtor visit which has made it unsafe for professionals to visit. (Image attached) The contractor was asked to provide copies of the documents including #foundation warranty, repairs, leak test and engineers report # copy of work permit # copy of hvac inspection # copy of roof inspection # copies/originals of any warranties on the big ticket material items # requests to release receipts including all the invoices to subcontractors were paid in for my lender for a draw and haven't submitted any of the documents requested. The lender initiated an inspection halfway through the project, but contractor did not answer the call / was not made available for the inspector, *****, I was unable to make a draw request due to those reasons and had to take a second loan out from 401K to complete the rehab. The last payment of $2000 has not been completed due to unsatisfactory completion of work, additional finance costs that I had to take due to stalling work, the house was not ready for final inspection. Reached out to contractor to request inspection report but did not provide, however the inspector provided a copy. Contractor was notified that his workers will not be retained for the remainder of the work.The contractor is threatening to file mechanical lien against the property. I have had other contractors bid on the remaining work to get the house ready for sale, but I have been notified that I will have to spend another $30,000 to get the house sold. I need assistance resolving this situation .
