    Freeman the Treeman was trimming my neighbors trees on Saturday, 2/24 and dropped a tree limb on our fence. It broke the top rail. (no picture of rail damage) It also cracked the post and knocked the fence out of alignment. The ******* said they would make the repairs and asked for the name of our fence company. Instead of having a qualified fence company come out to make the repairs, ********************** decided to do the repairs themselves. Their attempt to make this repair is shoddy and unacceptable. They went as cheap as possible on repairing our fence. They cut the openings for the pickets too wide and the pickets move back and forth in the top rail. (see picture). The top rail was cut short and can easily be pulled out of the posts. They wouldn't fix the cracked post or realign the one out of alignment. ****, my husband talked to *** ********************** and asked him to reimburse for the expense costs so that we could have the damaged fence area fixed properly, but *** ********************** has refused.

    Attached is the repair quote from our fencing company.  The repair is $330 to correctly repair our fence. This was submitted to *** Freeman and he has refused to reimburse us for the correct repairs.  please let me know if he has made any attempt to respond to this complaint?

    We made the repairs. I have sent pics and a video. He wants us to fix pre-existing damage.

    I am rejecting this response because:

    The repair was not made correctly.  A tree company is not a qualified vendor for making fencing repairs.  We were mislead by Treeman that they would enlist the services of our fence company to make the proper and necessary repairs to restore our fence to its original condition.  There was NO PREXISTING DAMAGE to the fence.  As previously submitted, the pictures show that the fence rail was not installed correctly, the pickets are lose because the slots cut in the top rail were not cut correctly.  The cracked post was damaged by the tree branch they dropped on our fence, this has not been repaired.  The fence is now out of alignment due to the tree branch falling on the fence.  This is not due to weather as Don ********************** is trying to claim.  Our fencing estimator also stated that the post did not move due to weather changes.  Treeman's worker did not take the proper steps to protect our property (fencing) when they were trimming the trees at our neighbors home.  ************* also admitted that fact.  I was told that the worker was fired from his job due his negligence on the job. 

    If Treeman is unwilling to pay us the $330 as stated in the repair estimate, will move forward with taking him to small claims court.

    08/14/2024 AB:  Consumer would like to reimbursed for the estimated cost for the repairs in the amount of $330.00, consumer will submit estimated cost to my email at ********************************************/  Consumer stated that the business attempted to make the repairs, but the business had the tree guy order a rail and cut out the pickets but the work that was done it not done right.  My fence was not crooked until the tree was dropped on the rail. Consumer does not want the business to do anything else to the fence.

    09/11/2024 AB: Called consumer left a vm.  I have looked at both videos and I think the business has made a good faith effort in attempting to fix the fence.  waiting to inform the consumer. 

    09/11/2024 AB:  Consumer called back informed the consumer of my finding, consumer would like to pursue this further going to arbitration.

    08/21/2024 AB: Business called back and spoke with *** *********************** he does not want to pay twice when he has paid already to have the fence repaired. I am willing to speak with the consumer at his residence.  Also, I have reached out to the consumer several times regarding this issue and I have not received any correspondence back. *** was giving my email at *************************************** to send over video regarding the fence.
