      On July 1st 2024 my basement flooded from a home I purchased from Inspired homes. After careful investigation involving 3 plumbers, 3 landscapers, a civil engineer and the city of Lees Summit. We discovered Inspired Homes illegally tapped into a city storm inlet. During a heavy rain the city storm inlet surged and backed up our sump discharge line to our home. Causing our sump to not allow water to pump out causing my basement to flood. After investigation and consulting all parties were unanimous in their opinion. The system drainage around my home was improperly and illegally installed. The city was clear there is no record of Inspired ever pulling a permit through the city or entering in an agreement. The city was also clear even if they would have applied for a permit to tap into the city storm they would have been denied. It is against city code because of the risk involved to home owners. This is exactly what happened in my case. After consulting a licensed civil engineer the water drainage around my house is not designed for the amount of water being diverted around my home. If Inspired homes had legally followed the city code this issues would have never happened. If Inspired homes would have consulted a civil engineer there would never have been such neglect in designing a water drainage system. This is a prime example of why builders get a bad rap. Cutting corners and not following city code.

      We strongly disagree with Mr.
      Leheney’s allegations.

      The following facts will clarify that the allegations of
      construction negligence are unfounded, and the actual cause of the basement
      flooding was an abnormally high rainfall event, inadequate home maintenance,
      and a failed sump pump.

      • The
      home was completed and inspected and passed for occupancy by the city of
      Lee’s Summit on April 24, 2018.
      • From
      April 2018 through June 2024, (6+ years), the sump and drainage systems
      performed as designed.
      • With
      the abnormally high rainfall total of nearly 6” of rain on July 1st,
      2024, coupled with the fact that the homeowner had allowed dirt to settle
      around the house to a level that allowed the runoff to flow toward and
      down the foundation instead of away from it, the sump pump was overwhelmed
      and failed. 
      • The
      homeowner had Gordon Energy replace the sump pump due to its failure.

      Many basements in the area that had never flooded before
      had the same unfortunate fate due to the unprecedented rainfall event. The attached video gives an indication of the severity of the rain event. This is water flowing between two houses one street over from *** ********
      house.

      I am rejecting this response because:  The implied warranty claims also fall under Missouri Law.  We are requesting the business inspects the following defects.  Then propose a solution to remedy the construction defects.  We are following the process set forth by our attorney.  We will not remove this complaint until resolution is met.
