    I recently learned that the legal description on my mortgage papers is not correct and I have asked them to correct it. I paid for a title insurance, that is connected to this document and I can't make a claim because it isn't protecting me but protecting the mortgager. The lot is correct, but under also is not correct. I can send a copy of the original survey. No one is wanting to correct this. The error that is on the description can shift the whole subdivision, so that is not properly diagrammed. It makes it appear that part of my land has been transferred when it hasn't.

    I am attaching the paperwork for *******:

    1.  Trustee's Deed:  ******* purchased the property in question from ****** ** ******, trustee of the ****** ** ****** Trust agreement dated June 29, 1999, and ****** ** ******, as successor trustee of the **** ** ****** trust agreement dated June 29, 1999.  I am not sure who prepared the Trustee's Deed.  Hogan Land Title of Laclede has never insured this property for *******.

    2.  2016 ****** ****** ***** ordered a loan policy for K. *******.  We prepared the title commitment closed the loan.  ******* signed all documents and never questioned anything.  The mortgage affidavit is an affidavit that stays in our file.  The mortgage affidavit does not convey title.  ******* wants the ******** ** ***** *** ***** ** **** ** *** ***** ********* ******** removed from the affidavit.  ******** ***** *** ***** **** is a locator for the property.  We are required to put this on all meets and bounds legal descriptions.  If you notice the Quit Claim Deed from her husband has the same language.  The Quit Claim Deed from her husband has the same language.  The Quit Claim Deed does convey title.

    3.  This all started a couple of years ago when the land next to the ******* property was being surveyed for a new dentist office.  ******* has several complaints about the survey.  She accused the surveyor of stealing her land.  During the time the survey for the dentist's office was being prepared the chief of police had to be called regarding ******* and the surveyor.  ******* filed a complaint against the surveyor.  Then ******* filed a complaint against Hogan Land Title with the Department of Insurance.  I received a letter from the Department of Insurance that this case was closed and Hogan did no wrong doing.  The next step ******* filed a complaint with the underwriter for Hogan Land Title.  We did not insure the property for *******.  The next step ******* took was to turn the recorder in for filing her deed.  The Mortgage Affidavit is not filed of record.  Now I receive a letter from the BBB.  There is nothing wrong with title for Kathryn *******.  I reached out to an attorney yesterday.  ******* is not allowed in our office or the office of the surveyor.

    The documents don't match.  The document has been falsified.  I sent copies of the originals. The beneficiary deed is also incorrect.  The deed for the mortgage loan is wrong.

    If you look at page 004/011 at top right corner ,from Hogan Land Title of Laclede you will see the Legal Description ( doesn't match)...So I do reject it's position. I'm sending the Affidavit By *********, Look at it after the word

    I explained this earlier:  Affidavit of ********* is for the binder and does not covey title.  Legal description is correct.  Our legal description is correct.  The Quit Claim Deed from her ex-husband has the same legal.  See Attached.

    I have answered all of the questions regarding this matter.  The legal description on the Mortgage Affidavit is correct.  Township North, Range West of the fifth Principal meridian is a locator.  I cannot change paperwork that was completed in 2016.  She has title from her X-husband with the same legal description.  The Mortgage Affidavit does not convey title.  The Mortgage Affidavit is for the lender and my file.  Thank you.  Please let me know that you received this.
