1. The roof leaks we have allowed them to come back twice to fix it and it leaking worse than ever. They have made a mess of the roof. We are requesting that they get a licensed roofer approved by the customer to fix the problem.
2. The outer door leakes from the top and the bottom of the door, and we want them to get it fixed correctly or replace the door. They have attempted to fix it one time.
3. The four season room the vent is not getting any airflow there for it is not getting any heating, they offered to put in a second vent the same as they did the first vent but we denied that because the first vent is not getting any airflow. We want it done right. We prefer a license HVAC contractor to do it right.
We want the problems fixed by people who know what they are doing, we have paid them $40,000.00Business Response

This is a timeline of the events leading up to this Homeowner
filing a complaint. We are not sure how to proceed at this point, but they made
it clear that they have already contracted with someone else to fix things and
we are in no position financially to compensate them for that. We fully feel
that our work was tampered with.
2/8/23 first rain and notification of water leaking (complaint
says 2/9). Homeowner requested our certificate of insurance which was sent over
on the same day. I assured them that once we address all of the leaks, any water
damage would be corrected. We came out on Feb 10th and re-flashed
the roof.
2/14/23 Homeowner emailed during a rain confirming that the
only leaking that remained was around the outside of the storm door and that
some water came in from underneath it. No more leaking coming from the roof or
windows. A service was scheduled for February 28th to address a few
other cosmetic items.
2/15/23 They emailed saying that they did not like the view
of the room and they wished they had more glass. They also stated that they
would be having this room “corrected” and asked if we would do the correction,
almost hinting at it being “our fault” We were very taken aback by this since
they had sent an email less than a week earlier saying how much they loved it
and had coffee in it every morning.
2/20/23 Homeowner emailed with multiple new complaints with
the structure including the number of vents we installed and how they were
installed. They went on that they temperature was not warm enough and that they
went and consulted another HVAC person who quoted them to install a $4000 unit.
We brought up a conversation that was had between the Homeowner and ***
regarding the wood burning stove keeping the house at a temperature that the
heat did not kick on and that they had an accessory heater to pick up the
slack. We offered them another vent at no cost and explained that any additional
vents would have to be charged. They agreed through email for the additional
vent.
2/22/23 Homeowner emailed with more water coming into the
structure. We kept our date of Feb 28th
2/28/23 The roof was again re-flashed. The only sealant that
was used is the proper flashing sealant. We addressed a few other items for the
Homeowner while there as well. One of the items was the storm door. We
installed a drip cap to try and divert water. The door installed is a “Storm Door”
which was what the homeowner wanted. We had offered, prior to beginning the
project, a sliding glass door which would have provided much more protection
from the elements but they did not want the additional cost for that change. While
on the service *** was told by the Homeowner that they did not want another
vent installed. They wanted 2 or nothing. *** explained that he would not do two
for free only one and that he only had the materials to do one that day. The
Homeowner made it clear that they did not want the one vent. *** did his
service and when the Homeowner did not come back to talk to him, he assumed
that they truly did not want the vent. He left for his next service call. The
office was to discuss the HVAC with the Homeowner through email so things were documented.
We explained that all the other cosmetic concerns could be addressed at a later
date and we just want to make sure there are no more leaks. The Homeowner again
asked for a date for the other items to be completed and again said they do not
like the way the vent is installed.
3/3/23 Homeowner emailed stating that the leaking is worse
than ever. We responded immediately saying we would be by Monday morning 3/6. Homeowner
then stated that they had inspections done by a home inspector, and HVAC
contractor and another home improvement contractor. This would have been prior
to the new leaking that is being observed. Now they wanted us to bring in a
roofer when we came on Monday morning.
3/5/23 9:12pm Homeowner sends email saying we are not
properly addressing the situation with the roof. Demands that we bring in a new
HVAC person to fix or replace our work, bring in a roofer to fix and replace
our work and bring in a contractor to fix or replace the outer storm door. All
at Badfish Constructions expense. Furthermore,
that if we did not agree to these terms by end of day 3/6 that they would file a
complaint with the BBB.
Since the homeowner had made it more than clear they did not
want it to be Badfish Construction doing any of the work, I emailed them back
letting them know we cannot meet their demands. If we can not fix it ourselves
and make it right for them, then they would have to move forward with their complaints.
She proceeded to email an additional time saying they do not
trust us to fix it and that they were contacting the BBB.
3/7/23 We got our formal complaint from your office at
7:59am. The homeowner sent an additional email at 8:49am to say she never told
us not to come on 3/6 and that she was already contracting the repair work to
other companies.
We are in no position to pay other contractors. We are a
small, family run business. We do not have savings and we have small children. It
is in our honest opinion that our work has been tampered with and this homeowner
is being deceitful. We truly wanted to fix the leak and move on with a happy
customer. We have been responsive and diligent in this entire process. We have
been in business for 10 years in total and have 30 years of experience. All
email and text correspondence can be given at any time if you need.Business Response

We were actively addressing the issues with leaking. Not one time did we dimiss anything or not show companssion. This is our hard work, afterall. The homeowner did express that the first rain after the first fix was light but the way it was worded almost seemed as if they wanted it to leak again. Our company has over 30 years of experience in the field. In our experience, you'd have to remove our work to see how the roof was attached. So any roofer saying we attached it incorrectly, tampered with our work. The HVAC is not improperly installed. The materials used are energy efficient and were chosen for the specific purposes that we used them for, getting the most heat/air into the room. An additional vent could have been all they needed. It was the homeowners choice to decline that offer. Everything that was contracted and paid for has been delivered. The storm door is an Anderson security door. Nothing cheap or lacking quality there. It just is a storm door, which is not an entry door. Which is what the homeowner wanted from the get go in the proposal process. During one of the contract amendments that occured before the project began, the Homeowner was offered an upgrade of a sliding glass door and it was declined. The job couldnt have been "too big for us to handle" since it is completed. We are in no position to give a refund of $5000. The homeowner was very clear that if we were not willing to pay another contractor that they would move forward with complaints.
Our position has not changed. We have not taken advantage of anyone.

I am rejecting this response because:
We are attaching pictures and video's showing the roof and attempts at "fixing". You can see just by looking at the pictures and videos that it was not tied into the house roof correctly and that Badfish Construction was relying on caulk and sealant to l prevent leaks, which would have eventually cracked and leaked anyway. The roofers who have come did not need to remove their work to see that it was done incorrectly and therefore nobody tampered with their work. A few of them are willing to attest to this. We did just recently contract with a roofer to fix the roof issues because they are critical and cannot wait. We do have to pay to repair our pre-existing roof that they damaged as well. We feel they need to reimburse us. They say they are not going to reimburse us, so we will need to move to the next step if the BBB cannot assist us in getting a resolution that is satisfactory. We do feel that they took on a job that they were obviously not skilled to do properly and therefore took advantage of us.
There are too many things wrong with this room that Badfish Construction built to list. We feel we are being fair by only asking them to reimburse us for the roof and the damage they caused to our house roof. The cost we were quoted for this is $4,500. We paid them almost $41,000 and will have to spend a lot more to correct their mistakes. We just keep finding more things that either do not work or are done improperly and poorly. They had plenty of opportunity to make this right and they only made it worse. We do not feel that we were out of line asking them to bring a qualified contractor to fix our roof, which they denied and resulted in this complaint.
Please let us know if the BBB is able to help.
Sincerely,
