    ***** requested $3000 from myself and my fianc as the down payment to properly repair our porch in September. We have a signed receipt from him for the amount and what it is for. The communication with ***** before we gave him our money was amazing. Once he got the money from us, he went off the map. Would ignore us for weeks at a time. ***** claims to have medical issues that has been preventing him from starting the job on October 9th as originally agreed upon. November 8th, my fianc messaged ***** that we would like our money back due to extremally poor communication and not starting the job yet. ***** has still ignored us and continue to claim, "health problems", but he claims he already bought the materials which does not make sense if he is having extreme health issues. Our porch is in very poor condition and could collapse at any time and that is why it is vital we get our money back so we can get a trusted contractor to perform the job.

    To today's date, 10/1/2023, I have received no communication whatsoever from David's Construction and Repair LLC regarding a refund of my money. it. I received no call back from *******. I again called him on April 13, 2023 and left a message but received no call back. On May 1, 2023, ******* contacted me by telephone and stated he would refund my deposit. I waited for approximately a month but did not receive any refund. So I contacted ******* by phone on June 8, 2023. He stated he had sent a check for the full amount of the deposit to me through the U.S. *************** I told him it never arrived. He said he would check with his bank to see what the status of the check he sent was and, if it had not been cashed, he would send a replacement. That same day, I texted him my address just in case he did not have it on file. I have texted and called ******* several times and left messages on his work phone since June 8, 2023, inquiring about the status of my refund on the cancelled job. ******* has not responded in any way and I still have not received my $6000.00 refund.

     This complaint is being worked out as of now. I am sorry that it got this far.  There are a lot of variables that came to play in this situation. I am still not ********************************************** being sick. I am normally fast and efficient in doing my work.  Again I'm very sorry that this happened and I am working to get his money to him. Thank you,  **********;
