  We had asphalt work needed at the end of our driveway
  The owner came and gave us an estimated including 534 dollar down payment on 2/7/23 we also received confirmation on 2/7/23 also that they received our 534 dollars. We understood that they were unable to do  that kind of work when its cold out. We regularly checked in for an estimated date of completion and finally they told us there was no asphalt yet
  so we continued to put it off . However, on there FB page we noticed they were doing other jobs
  They never contacted us. When we contacted them we were told multiple times that they would be there in 20 minutes and they never showed. After a while they quit answering my husbands phone calls
  so I called on my phone and immediately got an answer. The person was ******.  On June 12th I spoke with the owner **** and he told me our driveway would be done no later than June 15th.  We came home and nothing was done. He told me this on the phone and they still have not shown up to complete the job.  I sent him an email regarding his failure to start the job and we explained that we trusted him to do the job and he continues  ignoring our phone calls and indicated that  and that if we did not receive a refund by June 30 we would be taking him to small claims.  The email was read and ignored.  To add insult to injury we have seen on their website that they are doing jobs in Kansas City. My husband is 67 and not in the best health and I feel they took advantage of that and accepted our down payment and refused to do the work we trusted them to do.

  We do not have a contract with this consumer. We only do commercial work and not consumer work. They have our business mixed up with another business.

  I am once again sending the text message sent by Copas Asphalt on 02-07 at 11:38 a.m. stating they received the check for $534.00 as a retained for the job we wanted done.  I am also attaching a copy of the front and back of the check that was cashed by Copas Asphalt.  As you can see, the check has been signed by someone, and was deposited the same day it was written.  

  Copas has made multiple times when they will be there to complete the project , then they never show.   It has now been 7 months with no work completed.  They will not answer our phone calls or return phone calls now, and it is obvious they have taken our money and have no intention of doing the work.
