I totally reject LANDESIGNS response to my original complaint specifically for the following reason .

1..I NEVER told them to reduce the contract price by dropping less rock. That is a REAL REACH for the owner to use as a

defense for not finishing the job. That seems to be their ONLY defense. I would like to know who did I tell to reduce the amount of rock so I could save money? The only person I ever talked to before the owner was **** ***** who was the project manager and he knows I requested more rock on numerous occations during the project.

2..the owners only offering to resolve my complaint was to SHARE IN THE COST OF A BARGE. This is a small part of the cost of dropping more rockLANDESIGN IS LOOKING FOR ANY EXCUSE TO NOT INCURE THE COST OF FINISHING THIS PROJECT.

      Business Response

      Date: 09/30/2024

I run my business with professionalism and transparency. I always do the right thing even if it causes me to lose money. I am overly accommodating and generous and our nearly 5-star reviews reflect that. We strive to go the extra mile to satisfy our clients every day. But every once in a while, there is that one client that no matter what you do or how much you give, they aren't satisfied. It does not matter if the fault is their own making and if everything goes as planned.

Landesign was contracted to add rock to a *********. Mr. ******** did not like the price, and we built his proposal to fit his budget which meant less rock. He was informed by our salesperson that the coverage may not be adequate due to run off into the lake. We delivered and installed the tonnage of rock specified in the bid and he was given exactly what he paid for. We have the hauling receipts that correspond with the amount of rock that was delivered and installed.

Over a year later Mr. ******** contracted for us to do an additional hardscape project. He mentioned to the salesperson that he thought we should install more rock on the lake bank due to erosion. I personally went out and reviewed the scope of work and offered to add rock for an additional cost. To be accommodating I offered to waive the barge fees to add the extra rock.

We finished the hardscape project and Mr. ******** refused to pay the balance of $23,000 owed on the hardscape project until we addressed the rock issue from over a year ago. Mr. ******** was notified that this issue would be sent to collections and was given a deadline to submit payment, and he complied with the request.

I have 100% fulfilled the requirements of the contracts with Mr. ******** and our bid and the work performed are aligned. As stated, we were more than willing to increase the amount of rock on lake bank at a discounted additional cost with pre-payment before any work is performed.
